Road Traffic (Public Parking Places) (Jersey) Order 2006 - amendment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Amendment to Road Traffic (Public Parking Places) (Jersey) Order 2006 to schedule Ann PlaceCourt Street Car Park and CharlesBrooklyn Street Car Park on the Ann Court Site.

 

Decision(s): The Minister agreed to have the Road Traffic (Public Parking Places) (Jersey) Order 2006 amended.

 

Reason(s) for Decision:

1) To allow the Ann PlaceStreet Car Park to be established as a chargeable public car park for long stay parking, with a maximum stay period of seven consecutive days, and to permit overnight parking for commercial vehicles over 15ft in length.

2) To allow the CharlesBrooklyn St Street Car Park to be established as a chargeable public car park for short stay parking, with a maximum stay period of three hours during any one visit.

3) To remove Gas Place Car Park from the Schedule upon its closure.

AMENDMENT TO ROAD TRAFFIC (PUBLIC PARKING PLACES) (JERSEY)

 

ORDER 2006

TO SCHEDULE A SHORT AND LONG STAY CAR PARK ON THE

 

ANN COURT SITE

 

 

Purpose of the Report

 

To allow the Road Traffic (Public Parking Places) (Jersey) Order 2006 to be amended to provide public ‘Short Stay’ and ‘Long Stay’ parking at Ann Court

 

 

Background

 

Gas Place Car Park is to be closed to allow the creation of the Town Park and Ann Court has been identified as a replacement site for some of the lost public parking.

 

It is intended that the Ann Court site will provide a mixture of short stay shoppers parking and long term commuter parking. To be consistent with chargeable off-road public parking elsewhere in the Town, short stay shoppers parking will be limited to a maximum stay of three hours during any one visit and long stay commuter parking will be limited to a maximum continuous period of seven days.

 

The closure of Gas Place means the loss of overnight parking for commercial vehicles with a length of over 15ft, therefore it is also proposed to permit the overnight parking of these vehicles in the new car park.

 

 

Discussion

 

In order to be able to charge for parking at Ann Court and to allow TTS’s Parking Control Officers to police and enforce parking controls, it is necessary to schedule the Ann Court site as two separate public car parks, which will be divided and provided with separate entrances and exits.. The short stay area will be called CharlesBrooklyn Street Car Park, with 47 spaces, and the long stay area will be called Ann PlaceSt Car Park, with 133 spaces. The existing site walls, wooden hoardings, paint markings and signage will be used to clearly divide the short and long stay parking areas.

 

To provide for these changes the Road Traffic (Public Parking Places) (Jersey) Order 2006 will need to be amended to reflect this. A further amendment is also required to permit the overnight parking of commercial vehicles of over 15ft in length in the Ann PlaceSt Car Park. In addition to this Gas Place will also need to be removed from the Order upon its closure on 10 January 2011.

 

Parking within these two schedule Ann Court site car parks would be chargeable between 8.00am and 5.00pm at the rate of one unit per hour or part thereof and Season Tickets would be valid within the Ann PlaceCourt Long Stay Car Park.

 

 

 

 

Recommendations

 

The Minister is recommended to approve the establishment of Ann Place Car Park and Charles Street Car Park and Brooklyn St Car Park on the Ann Court site and to direct his Officers to instruct the Law Draftsman to prepare an Amendment to the Road Traffic (Public Parking Places) (Jersey) Order 2006 to incorporate this.

 

The Minister is further recommended to direct his Officers to instruct the Law Draftsman to prepare a supplementary Amendment to the Road Traffic (Public Parking Places) (Jersey) Order 2006 to remove Gas Place from the Schedule upon its closure.
