A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Transfer of Funds from the Social Security Department to the Home Affairs and Non Ministerial Department to address overspends in these Departments as a result of investigations currently undertaken by the Wiltshire Constabulary and Court and Case Costs.
Decision(s): The Minister agreed to make a transfer of funds from the Social Security Department amounting to £2.4 million in total, of which £606,000 was to Home Affairs and £1,794,000 to Non Ministerial Departments, with £220,000 of this allocated to the Bailiff’s Chambers and £1,574,000 to the Judicial Greffe.
Reason(s) for Decision: The Departmental Quarterly Financial Reports for September 2009 show overspends in respect of the Home Affairs and Non Ministerial Departments. At its meeting on 12 November 2009 the Council of Ministers considered the consolidated Quarterly Financial Report of all States funded bodies for the period to 30 September 2009 and agreed that sums equivalent to the anticipated underspend in the Social Security Department and Economic Development Department for 2009 would be made available to help address overspends elsewhere.

Introduction

The purpose of this report is to ask the Minister to agree to the transfer of funds of £2.4 million to the Home Affairs and Non Ministerial Departments in order to meet overspends in these Departments for 2009.

Background

As the Minister is aware, the Departmental Quarterly Financial Reports for September 2009 reported overspends in the Home Affairs and Non Ministerial Departments.

At its meeting on 12 November 2009 the Council of Ministers considered the Departmental Quarterly Financial Reports of all States funded bodies for the period ending 30th September 2009. The Council noted the consolidated position and the forecast overspends identified by the Home Affairs Department and Non Ministerial Departments.

The Council was advised that the Ministers for Economic Development and Social Security had agreed to make available sums equivalent to their anticipated under spends for 2009 to help address overspends elsewhere. The Council agreed that the sum of £185,000 from the Economic Development Department and the sum of £2.4 million from the Social Security Department should be made available to Departments with forecast overspends. Officers of the Treasury and Resources Department have advised that £791,000 will be made available to the Home Affairs Department and £1,794,000 will be available to the Non Ministerial Departments, of which £220,000 will be allocated to the Bailiff’s Chambers and £1,574,000 to the Judicial Greffe.

The Council noted that after the above transfers it was likely a further £1.1 million of any departmental surpluses at the year end would need to be transferred to address the residual shortfall on the Court and Case Costs budget.

Recommendations

It is recommended that the Minister:

approves the transfer funds of £2.4 million from the Social Security Department of which £606,000 will be transferred to the Home Affairs Department and £1,794,000 to Non Ministerial Departments of which the Bailiff’s Chambers will be allocated £220,000 and £1,574,000 to the Judicial Greffe;

seeks the approval of the Minister for Treasury and Resources to make this transfer in accordance with Section 5.7 of Financial Direction 3.6, Variations to Heads of Expenditure.
