P.131/2010 Samares Nurseries Petition - Minister's Comments

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

P.131/2010  Samares Nurseries – Removal from the draft Island Plan

 

Comment of the Minister for Planning and Environment

 

The draft Island Plan was published for consultation in September 2009.  The consultation closed on 31 March 2010.  During the period of consultation I was requested by the Constable of St Clement to withdraw the site from draft Policy H1, which proposes that the Samares Nurseries site be designated as a site for Category A housing (for first-time buyers and Jersey Homebuy homes).

 

My response to the Constable at that time was that the consultation process should run its course.  It would confuse the public to make amendments to the draft Island Plan while comments were being sought, and the consultation itself would enable representations by all parties to be made and be considered by the independent planning inspectors who would be considering the draft Plan, and the representations on it, at the Examination in Public in September 2010.

 

While the Constable’s view has been material in leading to my decision not to include this site in final Draft Island Plan, it is not the only reason.  The substantial petition which is the subject of this proposition is another factor.

Furthermore, there have been challenges to the stated requirement for new homes in the new Island plan, and I am awaiting the results of further work that is being undertaken jointly by the Chief Minister’s, Housing and Planning and Environment Departments to establish with greater clarity the overall requirement for new homes, and the breakdown by type and tenure.

 

Once the revised housing requirements are known, it is my intention, should there be a shortfall in the requirements, to enter discussions with the Parishes to establish whether there are suitable sites that can be brought forward in the final Draft Island Plan.
