Public Parking Places - New Charges.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Road Traffic (Public Parking Places - Charges) (Jersey) Order 2009 – Introduction of new fees and charges for Jersey Car Parking

Decision(s): The Minister made the Road Traffic (Public Parking Places - Charges) (Jersey) Order 2009, to become effective from 01 April 2009, the purpose of which is to introduce the previously agreed increase in the cost of a Parking Unit.

Reason(s) for Decision: To enable Jersey Car Parking to increase its scratchcard fees but by less than is required to maintain current cost recovery levels in recognition of the current economic climate.

Resource Implications: New window stickers will be required for retailers at an estimated cost of £4,750.

Action Required: Notify the Greffier of the States and the Law Draftsman that the Order has been made and forward the signed Order to the Publications Editor at the States Greffe immediately, for notification to the States.

TRANSPORT AND TECHNICAL SERVICES  

2009 INCREASES TO FEES AND CHARGES FOR JERSEY CAR PARKING  
 
 

Purpose of the Report  

To request the Minister to make the Order to introduce the previously approved increases in parking charges. 
 

Discussion  

On 27 February 2009, the Minister for Transport and Technical Services approved a request to increase the Department’s fees and charges for Jersey Car Parking (MD-T-2009-0006) and requested the Law Draftsman to amend the Road Traffic (Public Parking Places – Charges) (Jersey) Order 2008 to incorporate the increases as set out in the Appendix to the previous report. In summary, the Minister agreed to increase the cost of scratchcards by 3.2% but that season tickets remain at their current levels. 

The Treasurer of the States has approved these increases under his delegated authority.

 

Recommendations  

The Minister is recommended to approve the Road Traffic (Public Parking Places – Charges) (Jersey) Order 2009 to be effective from 1st April 2009.
