Fish Farm Licences: Modification of generalised (established fisheries) conditions for Jersey shellfish aquaculture industry

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Purpose of the Report

 

The Minister is responsible for the issue of fish farming licences on the seabed under the Sea Fisheries (Fisheries) (Jersey) Regulations 2010 and the Sea Fisheries (Jersey) Law 1994. This written report summarises the considerations surrounding the update of licence conditions to preclude stocking scallop concessions with dredged or transplanted scallops, unless authorised by the Minister in exceptional circumstances.

 

Background

 

Current licence conditions specify that scallop fish farming concessions must be re-stocked with a minimum of 10,000 seed scallops every two years. However over the last few years, fish farmers have found it difficult to source scallop seed for re-seeding, after the failure of the scallop seed hatchery in Scotland. There have been reports that some fish farmers have resorted to buying dredged scallops from fisherman, or transplanting wild scallops into their concession, from outside of their concession areas. This had lead to several concerns and complaints being made to the Department of the Environment.

 

On the 28th of March 2012, the Fisheries and Marine Resources Panel met and discussed the future viability of scallop concessions. The Fisheries and Marine Resources Panel heard how in the future, scallop seed will be able to be sourced from Ireland and potentially from a local hatchery. The Panel discussed how the use of dredged or “transplanted” scallops for re-stocking was not in the spirit of the original decision to grant concessions for scallop aquaculture.

Discussion

 

On the 28th of March 2012, the Fisheries and Marine Resources Panel recommended that fish farm licence conditions be changed to specify the following; that all scallops placed in the concession must be sourced from a hatchery. Transplantation of scallops from outside the concession or plantation of dredged scallops will not be permitted, unless otherwise stated by the Minister in exceptional circumstances.

Recommendation

 

The Minister is asked to approve the issuing of updated licence conditions, to all shellfish fish farms / established fisheries in the aquaculture industry.
