Le Braye Beach Deck Chairs: Beach Trading Licence Transfer

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister approved the transfer of the beach trading licence from Le Braye Beach Deck Chairs to Le Braye Jersey Limited, t/a Le Braye Café. This transfer is subject to the new concession holder being able to fulfil the terms and conditions that apply to the licence for this concession.  

Reason(s) for Decision:

Ministerial Decision MD-E-2014-0064 approved the request to transfer the licence held by the concessionaire of Le Braye Beach Deck Chairs to a third party of the licences holder’s choice.

 

The department subsequently received a letter from licence holder of Le Braye Beach Deck Chairs advising the department that he wished to proceed with the transfer of the licence to the owners of Le Braye (Jersey) Limited t/a Le Braye Café.

Resource Implications:

Additional income generated, no human or additional resource implications.  

Action required:

The Hospitality and Leisure Manager to notify Le Braye (Jersey) Limited, Le Braye Beach Deck Chairs and the Constable of St Brelade that permission has been granted by the Minister.

 Transfer of Beach Trading Licence from Le Braye Beach Deck Chairs to Le Braye (Jersey) Limited

 

Ministerial Decision MD-E-2014-0064 approved the request to transfer the licence held by the concessionaire of Le Braye Beach Deck Chairs to a third party of the licences holder’s choice.

 

The department has now received a letter from licence holder of Le Braye Beach Deck Chairs advising the department that he wishes to proceed with the transfer of the licence to the owners of Le Braye (Jersey) Limited t/a Le Braye Café.

 

This transfer is subject to the new concession holder being able to fulfil the terms and conditions that apply to the licence for this concession.

 

Le Braye Café Proposal – Submitted by the owners of Le Braye Café

 

Should we (Le Braye Café) be granted the opportunity we would immediately invest significant time and money into the area, and will enhance the situation considerably, as we have done and now proved at Le Braye Cafe.

 

We plan to pay for the JEC to install electricity to both bunkers to allow for secure storage of stores at the cafe and top quality beach furniture for hire. The smaller bunker which is at present covered in graffiti would be given an immediate makeover and transformed into a "Mini Le Braye" with tasteful wood cladding, Jersey Flags etc. and top quality deck chairs and loungers for hire. From this bunker our existing beach refreshments concession can then operate without  disturbance from generators or over use of vehicles and trailers on the beach. The Beach Ability wheel chairs can also be offered with proper beach access. The present tenant is not always on site and has not been able to maintain the area. We operate 12 months of the year and always maintain a vigilant watch on the whole area and work with the Parish with daily litter patrols.

 

Recommendation

 

The transfer of the licence will undoubtedly result in the enhancement of the surrounding area and the provision of items for hire will be greatly improved. The inclusion of refreshments sold from the bunker and the ability to maintain and be watchful of the area all year round would also contribute to towards an improved service for visitors, locals and the Parish.

 

My recommendation is for the Minister to approve the transfer of the licence from Le Braye Deck Chair Concession to Le Braye (Jersey) Limited t/a Le Braye Café as requested in the letter dated 29th July 2014.
