Percentage for Art: Mechanism and process.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Planning and Environment

  1. endorsed the proposal to secure specialist professional advice to help facilitate the delivery of public art thought the Percentage for Art mechanism;
  2. endorsed the role and specification of the Public Art Advisor (v6), as set out in the specification for such at appendix 1;
  3. endorsed the proposal to engage such advice on a retained consultancy basis;
  4. endorsed the proposal to fund the provision of such advice through the ‘top-slicing’ of 10% of any Percentage for Art contribution, through the means of a planning obligation agreement;
  5. stipulated that he wished to determine the appointment of the Public Art Advisor;
  6. endorsed the proposed amendment to PAN 3, Percentage for Art: December 2006, as set out at appendix 2, to reflect the changes to the process of securing public art and of the changed submission requirements;
  7. agreed to give consideration to the most appropriate means of providing further supplementary planning guidance relating to the requirement for and the use of pooled funds that might be derived from Percentage for Art contributions.

Reason(s) for Decision:

  1. specialist professional advice is required to help facilitate the delivery of public art thought the Percentage for Art mechanism, which is not presently available within the States of Jersey;
  2. the role and specification of the Public Art Advisor would help facilitate the delivery of public art through the PfA mechanism;
  3. this mechanism of engagement provides the most efficient and effective use of resources to secure this objective;
  4. a funding mechanism is required to resource this proposal in the absence of any other available resources;
  5. the Minister has a close interest in securing the best advice;
  6. to promote clarity;
  7. to promote clarity and transparency.

Resource Implications:

Financial implications related to the engagement of a Public Art Advisor are to be met from Percentage for Art contributions, and others will be sourced from the Planning and Environment revenue budget.

Action required:

  1. seek to engage a Public Art Advisor on the basis of that agreed, in terms of process and job specification;
  2. publish revised supplementary planning guidance Percentage for Art (October 2007).
