Fire and Rescue Service: Fees increase

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Increase in Fire and Rescue Service fees.

Decision(s): The Minister approved the increase in fees payable for services provided by the Fire and Rescue Service as detailed in the accompanying report and requested the Chief Fire Officer to liaise with the Law Draftsman over the drafting of the relevant Orders to give effect to the fee increases with effect from 1 January 2013.

Reason(s) for Decision: To enable the Department to increase the fees payable for fire certificates; the provision of technical fire safety advice; the provision of fire safety training; the provision of humanitarian services; and the charge for attending a malfunctioning automatic fire alarm, in line with the States Anti-Inflation Strategy.

Resource Implications: None other than those detailed in the accompanying report.

 

Actions required: The Chief Fire Officer to request that the Law Draftsman prepares the relevant Orders to give effect to the fee increases.

  1. Introduction

This report identifies the current and proposed future fee increases proposed for 2013 in line with the States of Jersey Financial Direction 4.1 January 2006.

  1. Current Fees and Proposed Fees

Our proposed fee increases are shown highlighted in the text extracted from our existing fees orders below.  The proposed increases in fees range from 2% to 2.9% in order that the fees may be ‘rounded’ either up or down to the nearest 1p where the fees are payable per square metre and to the nearest £1 in all other cases.  This assists in the administration of the charges and, as some of the increases exceed 2.5%, has been approved by the Minister for Treasury and Resources, delegated to the Treasurer.

The charges include the use of all equipment carried as normal complement. An additional charge will be made for any other expenditure incurred, including the costs of materials supplied or repairs to appliances and equipment that are directly attributable to the service rendered.

Where the provision of technical fire safety advice described in Article 2 requires the use of the following personnel of the Fire and Rescue Service 

 

(a)

any interview with Fire and Rescue Service officers at the rank of station manager or above

(a)     £100 to £102 per hour per officer interviewed

(b)

any interview with Fire and Rescue Service Officers below the rank of station manager

(b)     £75 to £77 per hour per officer interviewed

Note: the minimum charge for Fire and Rescue Service personnel services is for 1 hour, and the service is charged per quarter hour thereafter. Interview includes an interview in connection with an investigation, research or any other purpose.

Where the provision of technical fire safety advice described in Article 2 requires the use of the Fire and Rescue Service training room and training facilities 

(a)     £150.00 to £154.00 for over 4 hours use of training room in a day

 

(b)     £100.00 to £102.00 for up to 4 hours use of training room in a day

Note: the charge for providing technical fire safety advice or consultation is per hour. The minimum charge is for 1 hour, and the service is charged per quarter hour thereafter. The charge applies in respect of preparation and research time as well as the time during which advice is given.

search of Fire and Rescue Service records to establish whether any material or information is held by the Fire and Rescue Service in respect of any premises

Note: the charge for a search of the Fire and Rescue Service records includes the cost of providing a report as to whether any material or information is held by the Service, and the nature of any such material or information, but excludes the provision of a fire or other incident report or any other documents held.
