Jersey Police Authority: Appointment of Interim Chairman

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

DECISION AND REASON FOR THE DECISION:

 

The Minister appointed Dr Jason Lane as the interim Chairman of the Jersey Police Authority, effective from 28th August 2017.

 

The term of office of the current Chairman, Advocate Jonathan White, comes to an end on 27th August 2017.  Advocate White has indicated that he will not be seeking a second term.  Dr Lane has been a member of the Authority since February 2014 and has served as Deputy Chairman since July 2015.

 

A process will be undertaken to appoint a permanent Chair, along with any additional members of the Authority that might be required, before the terms of office for Dr Lane and the other members come to an end on 10th February 2018.

 

RESOURCE IMPLICATIONS:

 

Membership of the Authority is undertaken on an Honorary basis.

 

ACTION REQUIRED:

The Minister to inform Dr Lane of her decision.  The appointment process for a permanent Chair and any additional members of the Authority which may be required to commence in due course.

The States of Jersey Police Force Law 2012 provides that the Police Authority shall consist of not less than 5 and not more than 7 members, comprising a Chairman, who is not an elected member of the States Assembly, appointed by the Minister; up to 4 members, not being elected members of the States Assembly, who are appointed by the Minister and the Chairman; and up to 2 members who are elected members of the States Assembly, appointed by the States Assembly by secret ballot.

 

Advocate Jonathan White was appointed as Chairman of the Jersey Police Authority for a period of 4 years from 27th August 2013 (MD-HA-2013-0050).  Advocate White has indicated that he will not be seeking a second term of office.

 

The Minister appointed Dr Jason Lane as a member of the Police Authority for a period of 4 years from 10th February 2014 (MD-HA-2014-0008).  Dr Lane, who has served as Deputy Chairman of the Authority since July 2015, to be appointed as interim Chairman effective from 28th August 2017.

 

The initial terms of office for the current members of the Authority, including Dr Lane, will come to an end on 10th February 2018.  A process will, therefore, be undertaken, overseen by the Jersey Appointments Commission, to appoint a permanent Chair and any additional members of the Authority that might be required.
