Sea Fisheries (Jersey) Law 1994: Regulation: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Approval to request law drafting for a regulation under Sea Fisheries (Jersey) Law 1994

 

 

Purpose of the Report

 

For the Minister to request law drafting time to make a regulation under the Sea Fisheries (Jersey) Law 1994 to allow for the creation of a zone at Les Ecrehous that prohibits the setting of certain types and design of pot.
 

Background

 

Since 1997 the use of certain pot types has been prohibited at Les Minquiers. The Sea Fisheries (Les Minquiers) (Jersey) Regulations 1997 sets out a zone whereby any parlour pot and any pot or trap that is so constructed that fish (other than molluscs) cannot escape, are prohibited.   

 

In 2007 this regulation was amended to include pots with restrictive entrances, colloquially known as “floppy neck pots”. It was done to accommodate a trend in the use of gear type that effectively mirrored the parlour pot but was not covered by the legislation.

 

It is generally agreed that the ban of these very efficient pots at this key habitat has been of benefit to the stock of targeted shellfish species, primarily the lobster. Following discussions at the Joint Advisory Committee and the Joint Management Committee of the Bay of Granville Agreement it has been agreed to recommend that a similar zone be established at Les Ecrehous.    

 

Details
 

The proposal for a parlour pot free zone at Les Ecrehous was first put forward by the Jersey Fishermen’s Association in the Joint Advisory Committee meeting held in June 2015. The proposal was subject to further discussion at subsequent meetings in October 2015 and February 2016. In February 2017 the Joint Advisory Committee agreed the co-ordinates for a zone at Les Ecrehous.

 

The concept of a Parlour Pot Zone at Les Ecrehous had previously been discussed and supported by the Marine Resources Panel in March 2016.

 

 

Recommendation

 

The Minister is recommended to request law drafting time for a regulation under the Sea Fisheries (Jersey) Law 1994.
