Social Security Agreement with Netherlands.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

· To note the Decision of the Minister for Social Security approving the text of the Convention on Social Security between the United Kingdom and Netherlands, in respect of Jersey, and to refer the matter to the Chief Minister;

· To approve the draft Report and Proposition regarding a Social Security (Reciprocal Agreement with the Netherlands) (Jersey) Act 200- and to request that it is lodged as soon as possible, for debate by the States in September 2006.

Reason(s) for decision:

The Convention on Social Security between the United Kingdom and Netherlands was signed in December 2005, to allow the Netherlands to continue to export pensions to Jersey notwithstanding a change in the Netherlands Law. The Agreement now needs to be ratified by all parties, with the implementation date being the third month following completion of all legal procedures by all parties.

A copy of the Decision of the Minister for Social Security (28 June 2006) and extract of the report prepared by the Social Security Department, which support the implementation of this Agreement, are attached.

It is proposed that a UK Order in Council to give effect to the Convention might be put before the Privy Council in the Autumn.

The text of the Agreement has to be agreed by the States of Jersey before the Agreement is ratified in respect of Jersey.

The Chief Minister has responsibilities for matters of international relations affecting Jersey, and is the appropriate person to lodge the attached Act.

Action required:

· Notify the Greffe of the decision and to forward the the Greffier the attached draft Report and proposition and the draft Social Security (Reciprocal Agreement with the Netherlands) (Jersey) Act 200-

· Greffe to lodge the draft Social Security (Reciprocal Agreement with the Netherlands) (Jersey) Act 200- as soon as possible, for debate by the States in September 2006.
