Pedal Cycles (Jersey) Order 1998: Amendment of Technical Specification for Electrically Assisted Pedal Cycles: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Reason(s) for Decision: To ensure that compliant pedal cycles manufactured in other judications can be used in Jersey, as pedal cycles complement the Islands move towards a more Sustainable Transport system.

AMENDMENT OF TECHNICAL SPECIFICATION FOR ELECTRICALLY ASSISTED

 

PEDAL CYCLES

 

 

Purpose of the Report

 

To seek the Minister’s agreement to instruct the Principal Legislative Drafter to draft Order amendments to the Pedal Cycles (Jersey) Order 1998, to amend the technical specification for electrically assisted pedal cycles.

 

 

Background

 

The Pedal Cycles (Jersey) Order 1998 was enacted on 2nd November 1998 and included a technical specification for electrically assisted pedal cycles to match those required in the UK at the time. Subsequent minor revisions have been made to the Order in respect of the technical specifications, the latest being in September 2015.

 

 

Discussion

 

Based on the information available the revisions made to the original 1998 Order reflect minor changes to meet the requirements of operating electrically assisted pedal cycles in Jersey.

 

In January 2015 the UK made significant amendments to its “Electrically Assisted Pedal Cycle Regulations”, to reflect Regulation (EU) No 168/2013 (the approval and market surveillance of two or three wheeled vehicles and quadricycles). This European regulation provides “improved conformity of production” and “ensure a high level of vehicle functional safety, occupational safety and environmental protection” primarily in L-category vehicles. However, the detail of this regulation has evolved into significant and rapid changes and in particular within the commercial pedal cycle market.

 

The amendments to the UK Regulations included the following main points:

 

 The removal of a weight limit for either bicycles/tandems & tricycles;

 Update to the reference to power output of the electric assistance motor;

 An increase to the maximum speed from 15mph to 15.5mph (25kph).

 

 

Recommendation

 

The Minister is recommended to agree for changes to be made to the Pedal Cycles (Jersey) Order 1998, to ensure that the legislation matches the requirements in both the UK and EU.
