Le Squez Redevelopment Phase 2c: Approval of Construction Plans

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Assistant Minister approved, as recommended by Jersey Property Holdings (JPH), the construction plans for Le Squez Phase 2C in accordance with the requirements of Standing Order 168(1)(d) as set out in the accompanying report.

 

Reason(s) for Decision:

The Minister approved under Standing Order 168 (1) (d) the above land transaction.

 

Resource Implications:

The project is to be funded from the Housing Department’s capital budget.

 

Action required:

Property Transaction for Ministerial Decision - Minister for Treasury and Resources

 

Subject: Redevelopment of Le Squez Phase 2c: APPROVAL UNDER SO168

 

Purpose

The Assistant Minister is asked to approve the proposed Phase 2c redevelopment of Le Squez under Standing Order 168(1)(d).

 

 

Background

The proposed development is Phase 2c of a multi phased approach to the redevelopment of the Le Squez estate. The Housing Department is seeking to progress tenders for this phase.

 

 

Details of Proposed Works

 

The proposal is to develop 24 social rented units as set out in the feasibility study annexed to the Housing Department’s Ministerial Decision MD-H-2012-0067 (copy attached).

 

Jersey Property Holdings (JPH) has reviewed the information provided by the Housing Department, but has not re-performed the calculations provided by the project quantity surveyor.

 

JPH has not independently validated the Housing Department requirement for unit types, however it is noted that the No.3, three bed house units have specific disabled adaptations with through floor lifts which increases the average cost. These units are for known applicants waiting for appropriate accommodation to become available.

 

The stated construction cost of £1,300 per sq m (£120 per sq ft) is within the expected range for development of this housing type.

 

The overall cost of the development is forecast to be within the Housing Department’s £4.5m budget, taking into account sunk fee costs met from earlier phases.

 

 

Recommendation

That the Assistant Minister, under his delegated authority, approves the construction plans for Le Squez Phase 2c in accordance with the requirements of Standing Order 168(1)(d).
