Conservation of Wildlife (Jersey) Law 2000: Proposed amendments to Schedule 1

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister authorised the drafting of the amendment to Schedule 1 of the Conservation of Wildlife (Jersey) Law 2000 to substitute the scientific name given for the Jersey bank vole (Clethrionomys glareolus ssp. caesarius)  with the scientific names (Myodes glareolus spp. caesarius also known as Clethrionomys glareolus ssp. caesarius).

 

The Minister authorised the drafting of the amendment to Schedule 1 of the Conservation of Wildlife (Jersey) Law 2000 to substitute the scientific name given for the palmate newt (Triturus helveticus) with the scientific name (Lissotriton helveticus also known as Triturus helveticus).

Reason(s) for Decision:

The proposal accords with the States Strategic Plan of implementing the Biodiversity Strategy.

 

The proposed Amendment would confirm the protected status of the populations of the Jersey bank vole and palmate newt found in Jersey for the purposes of the Law.

  1. Recent research and modern DNA analytical techniques sometimes leads to greater understanding of the relationships within and between species. Recent research supported by the International Union for the Conservation of Nature (IUCN) has required a change in the taxonomy of species which are represented locally.

 

 The Jersey Bank Vole is an endemic sub-species of bank vole which               only exists in Jersey. It has recently been assigned to a different               Genus. It is currently described in Schedule 1 of the Conservation of               Wildlife (Jersey) Law 2000 as Clethrionomys glareolus ssp. caesarius and               the               naming has changed to Myodes glareolus ssp. caesarius. In order to               ensure that the correct species is identified in the law it is proposed to               replace the name Clethrionomys glareolus ssp. caesarius with the words;               Myodes glareolus spp. caesarius also known as Clethrionomys               glareolus ssp.               caesarius

 

  1. The palmate newt, Jersey’s only newt species has also recently been assigned to a new Genus. It is currently described in Schedule 1 of the Conservation of Wildlife (Jersey) Law 2000 as Triturus helveticus and it is proposed to change the wording to Lissotriton helveticus also known as Triturus helveticus

 

  1. A single specimen of the Early Spider orchid Ophrys sphegodes, last recorded in Jersey in the 1920’s, was found earlier in 2013. It is proposed to add the orchid to the list of protected plants described in the Conservation of Wildlife (Protected plants) (Jersey) Order 2009 of the Law in order to ensure that all orchid species growing wild in Jersey are protected.
