A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Reason(s) for Decision: A caretaker’s vehicle is required for Victoria College Prep to aid any maintenance needed in school grounds and also to move/pick up equipment for the school. The funds for the purchase of the school vehicle which are currently included in revenue budgets are required to be transferred to capital to comply with GAAP requirements

Purpose of Report

For the Minister for Education, Sport and Culture to approve the following revenue to capital transfer in order to comply with GAAP requirements:-

£15,753, representing the money required to finance the purchase of a vehicle for Victoria College Prep

Background

This purchase is to replace an aging caretakers van, the purpose of which is to aid school maintenance and move/pick up equipment across the school. The van will not be used to transport children. The total cost is £15,753 and needs to be transferred from a revenue account. There are no other manpower or cost implications, both staffing and maintenance costs have been identified from the current resources allocated to the school. JFM were consulted on the purchase of the vehicle and gave a price for a vehicle that is about to be discontinued; this coupled with a slightly more expensive cost led us to the alternative vehicle. JFM have agreed that the chosen vehicle is suitable for the schools needs.

Under Financial Direction 3.6 para 5.2, the approval of the Treasurer of the States is required for transfers up to £1,000,000.

Recommendation

That the Minister for Education, Sport & Culture approves the transfer of £15,753 from revenue to capital, to fund the purchase of the caretakers van for Victoria College Prep.
