Road Traffic (St. John) (Jersey) Order 1982: Approval of request from Parish for amendment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

ROAD TRAFFIC (ST JOHN) (JERSEY) ORDER 1982 AMENDEMENT REQUEST

 

 

Purpose of the Report

 

To amend the Road Traffic (St John) (Jersey) Order 1982 to make permanent the trial of a restricted parking area and to introduce new prohibition of waiting restrictions on La Route du Nord and La Route du Mont Mado.

 

 

Background

 

Temporary amendments under Article 68 of the Road Traffic (Jersey) Law 1956

 

In April 2012 a temporary amendment to the Road Traffic (St John) (Jersey) Order 1982 was made using powers granted under Article 68 of the Road Traffic Law.  The amendment, which introduced a parking restriction on La Route du Nord, adjacent to the village shops, is temporary and after 12 months must be amended into the Parish Road Traffic Order if it is to become permanent.  Both TTS and the Parish Connétable are now satisfied that the amendment is appropriate and therefore wish the change to be included in the Parish Road Traffic Order.

 

Amendment to Schedule 2 “Prohibition of Waiting” of the Road Traffic (St John) (Jersey) Order 1982

 

The St John Roads Committee has requested the placing of “Prohibition of Waiting” lines in two locations, La Route du Mont Mado and La Route Du Nord, in an effort to improve road safety.

 

 

Discussion

 

The temporary amendment made in April 2012 is summarised below.

 

La Route Du Nord: -

 

  • Waiting Restricted - Maximum 20 Minutes During Any One Stay “East edge (From its junction with La Rue du Temple to its junction to La Rue de L’Eglise)”

 

Amendments to Schedule 2 “Prohibition of waiting” summarised below

 

La Route Du Nord:-

 

  • East side – from a point 10 yards south of La Rue de L’Eglise to a point 10 yards North of La Grande Route de St Jean

 

The new restriction is required to prevent motorists parking to the south of La Rue de L’Eglise. This habit has been noticed since the 20 minute waiting time limit was introduced on La Route du Nord.  Parking in this location is considered to be dangerous as cars park on the blind bend before the junction with La Grande Route de St Jean.

 

La Route du Mont Mado

 

  • East Side from a point 10 yards north of La Rue des Issues to a point 100 yards further North

 

The new restriction is required on La Route du Mont Mado to improve entry and exits for residents leaving the estates on the west side of the main road.  The Parish Roads Committee believes it would be beneficial to restrict on street parking on the same side as the estate exits.

 

 

Recommendation

 

The Minister is requested to approve the request.

 

 

Reason (s) for Decision

 

To amend the Road Traffic (St John) (Jersey) Order 1982 to make permanent the temporary parking restriction on La Route du Nord and to introduce prohibition of waiting into some articles where errors have been noticed.
