HMP La Moye - New Horticulture Training Facilities: Approval of Drawings and Acceptance of Tender

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  La Moye Prison (Phase 4) - Approval of Drawings and Acceptance of Tender to Construct New Horticulture Training Facilities.

Decision(s):

(a)  In accordance with paragraph 1 (d) of Standing Order 168, the Assistant Minister, under delegated authority, approved drawings numbered/ref: 5169_R001_pdas; 5169 00_PL(00)001 Rev1; 5169 02_3D(20)01 Rev1; 5169 00_EX(20)001Rev1; 4169 03_PL(20)05 Rev2; 5169 00_GA(00)003 Rev7; 5169 00_GA(00)100 Rev2; 5169 00_GA(00)101 Rev2; 5169 00_GA(00)102 Rev1;5169 01_EL(21)005 Rev5 and 5169 02_ PL (20)011 Rev4 all showing the proposed horticultural training facility works at La Moye Prison.

 

(b)  The Assistant Minister agreed to accept the lowest fix price tender submitted by ROK Construction Limited in the sum of £298,986.23 to construct a new Horticultural Training Facility at La Moye Prison; and enter into a formal JCT Building Contract.

 

(c)   The Assistant Minister approved a non-recurring budget transfer of £30,300 from Home Affairs revenue Head of Expenditure to the T&R (JPH) Prison Improvements capital Head of Expenditure.

 

(d)  Article 2(6) of the Public Finances (Transitional Arrangements) (Jersey) Order 2011 states that all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be used for the purposes of another head of expenditure.

 

(e)  Treasury and Resources delegation 1.13 delegated of all of the functions conferred on or vested in the Minister by or under the Public Finances (Jersey) Law 2005 including those in Regulations approved under that Law and financial directions to the Assistant Minister for Treasury and Resources

 

Reason(s) for Decision: 

The drawings noted in item (a) above for which Planning approval has been granted (Permit P/2011/1702 refers) reflect the use for which the funding is provided.

Under Standing Order 168 (1) (d), it is a requirement for the Minister for Treasury and Resources to approve plans for the construction (or alteration) of buildings where the work is to be funded wholly or partly by money voted by the States.

The estimated total cost for the works at La Moye Prison (including the lowest tender received, professional fees and ‘other’ costs), as designed, can be completed within the allocated budget.

The lowest fix price tender submitted by ROK Construction Limited in the sum of £298,986.23 can be accepted and a contract entered into.

The Acting Director is to sign the contract and any other associated documentation.

Resource Implications:

Other than those detailed in the report there are no further financial or manpower implications.
