Budget Transfer: Jersey Employment Tribunal to Judicial Greffe

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Transfer of the Jersey Employment Tribunal budget of £45,000, £50,000, and £50,000 in 2013, 2014 and 2015 respectively from the Social Security Department to the Judicial Greffe. 

Decision(s): The Social Security Minister is recommended to approve a recurring budget transfer of £45,000, £50,000, and £50,000 in 2013, 2014 and 2015 respectively from the Social Security Department to the Judicial Greffe. 

Reason(s) for Decision: To maintain the independence of the process from the Social Security Department, the role that supports the registration and administration of tribunals and appeals bodies established under Social Security, Income Support, Health and Safety and employment legislation was transferred to the Judicial Greffe in 2011. The budget assigned for its administration was permanently transferred at £168,300 with effect from 1 January 2011 to facilitate this (refer Social Security Minister’s Decision MD-S-2011-0023). This has been reviewed and found to be insufficient to cover the additional costs of running the service and added workload of members of the Tribunal requiring a further transfer of funds. 

Resource Implications: The Social Security Department’s revenue head of expenditure to decrease by £45,000, £50,000, and £50,000 in 2013, 2014 and 2015 respectively and the Judicial Greffe revenue head of expenditure to increase by £45,000, £50,000, and £50,000 in 2013, 2014 and 2015 respectively.

Action required: The SSD Director of Finance and Governance to notify the Head of Financial Control and Accounting, Treasury and the SSD Finance Manager that this decision has been approved. Copy of signed decision to be submitted to the Treasury Department.

Transfer of Jersey Employment Tribunal budget from Social Security to Judicial Greffe

 

  1. Purpose of Report

 

To enable the Minister for Social Security Department to approve a budget transfer of £45,000, £50,000, and £50,000 in 2013, 2014 and 2015 respectively from the Social Security Department to the Judicial Greffe.  This represents a growth bid relating to the administration of the Jersey Employment Tribunal, with effect from 1st January 2013.

 

  1. Background

 

The transfer of service from Social Security to Judicial Greffe originally occurred in 2011 under delegated decision TR-2011-DD43 with a recurring transfer of budget in 2012.  However, at the time of transfer, insufficient budget was transferred from the Social Security Department owing to an increase in service demand, and it was agreed by both departments that a growth bid would be made by the Social Security Department in the Medium Term Financial Plan (MTFP) to cover the shortfall.

 

The bid was approved in the MTFP and agreed that 2013 funding would be met from Central Contingencies and from growth in 2014 and 2015.

 

 

3. Recommendation

 

The Minister is recommended to approve a budget transfer of £45,000, £50,000, and £50,000 in 2013, 2014 and 2015 respectively from the Social Security Department to the Judicial Greffe. 

 

4. Reason for Decision

 

To provide a revenue budget to the Judicial Greffe to fund administration of the Jersey Employment Tribunal.
