Sand Racing (No.2) (Jersey) Order 2014 and Road Racing (Hill Climb and Sprints) (No.2) (Jersey) Order 2014

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: The Sand Racing (No.2) (Jersey) Order 2014 and the Road Racing (Hill Climbs and Sprints) (No.2) (Jersey) Order 2014.

Decision(s): The Minister made the Sand Racing (No.2) (Jersey) Order 2014 and the Road Racing (Hill Climbs and Sprints) (No.2) (Jersey) Order 2014 as prepared on behalf of Transport and Technical Services, as the administering authority of the Motor Vehicle Races (Jersey) Law 1946.

Reason(s) for Decision: Further to MD-T-2014-0117, enabling preparation of the Orders, the Minister accepted that the proposed road closures and associated traffic management were both reasonable and justified.

Action required: To notify the Publications Editor and the Law Draftsman that the Orders have been made, forward the signed and sealed Orders to the Publications Editor, States Greffe, and request the Greffier of the States to arrange for their notification to the States.

THE JERSEY MOTOR CYCLE AND LIGHT CAR CLUB’S APPLICATION TO

 

HOLD HILL CLIMB, SPRINTS AND BEACH RACING EVENTS IN 2015

 

 

Purpose of the Report

 

To accompany the signature copy of the Sand Racing (No.2) (Jersey) Order 2014 and the Road Racing (Hill Climbs and Sprints) (No.2) (Jersey) Order 2014, enabling the proposed road and beach racing events during 2015.

 

 

Background

 

The Jersey Motor Cycle and Light Car Club (the Promoter) has submitted details of its proposed road and beach racing events during 2015. The events are enabled by Order of the Transport and Technical Services Minister under Article 2 of the Motor Vehicle Races (Jersey) Law 1946.

 

Also as per the requirements of the Law, Economic Development (Jersey Tourism) has been consulted regarding proposed sand racing events. In addition, the Promoter has gained Parish approval for all of its events. They have also supplied proof of public liability Insurance.

 

 

Discussion

 

Hill Climb and Sprint: The proposed event timings for this year’s fixtures are similar in number to last year (see attached schedule), with:

 

  • Four ‘Five Mile Road Sprints’ requiring the closure of the road between 10am and 6pm, from the Car Park at La Pulente to the Car Park at Le Braye. The events will be held on Saturdays.

 

  • Four ‘Bouley Bay Hill Climbs’ requiring the closure of the hill between 8am and 6.30pm. These events generally fall on public holidays.

 

Sand Racing: As usual the Promoter has applied to hold events on the beaches at Millbrook, West Park and St Ouen (Le Braye). Their intention is to hold a total of eight sand racing events this year (a reduction on last year by four), including three at West Park, with one finishing as late as 7.15pm.

 

 

Recommendation

 

The Minister is recommended to make the Sand Racing (No.2) (Jersey) Order 2014 and the Road Racing (Hill Climbs and Sprint) (No.2) (Jersey) Order 2014 as prepared.

 

Reason(s) for Decision

 

Further to MD-T-2014–0117, enabling preparation of the Orders and following consultations, the proposed closures and associated traffic management are reasonable and justified.
