Information about the publication of Ministerial Decisions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister approved the nominations of  Mr Tom McKeon (Director of Education, Sport and Culture), and  Mr Peter Robinson (Assistant Director – Finance) To the Jersey Teachers’ Superannuation Board of Management to act as representatives for the Employer’s side
Reason(s) for decision: Article 4 of the Teachers’ Superannuation (Administration) (Jersey) Order 200- gives the Minister of Education, Sport and Culture the power to nominate two representatives to the Board of Management to act for the Employer’s side. The Minister is recommended to nominate the above persons who have the relevant experience to act in such a capacity of outlined in the attached Report.
Action required: Assistant Director – Finance to inform the Chief Minister’s Department of nominated representatives.

1. Purpose of Report

1.1. The Minister is asked to approve two nominations to the Board of Management of the Jersey Teachers’ Superannuation Fund.

2. Background

2.1 Article 4 of the Teachers’ Superannuation (Administration) (Jersey) Order 200- requires the following that membership of the Employer’s side of the Board of Management consists of six representatives in total, two to be recommended by the Chief Minister, two by the Minister for Treasury and Resources, and two by the Minister of Education, Sport and Culture.

3. Comments

3.1 Following a joint recruitment and selection process on behalf of the Chief Minister and the Treasury and Resources Minister the following are to be nominated by the Chief Minister in the above capacity:

· Mr Tom McKeon, and

· Mr Peter Robinson.

3.2 Mr Tom McKeon – Mr McKeon has held the post of Director of Education, Sport and Culture for 10 years, prior to which he was Assistant Director (Schools and Colleges) from 1992 to 1997. His earlier career was in schools in the United Kingdom, followed by two headships in the Island.

3.3 Mr Peter Robinson – Mr Robinson is currently Assistant Director – Finance in the Department of Education, Sport and Culture. He has worked in the States since 1990 and has previously held senior finance posts within the Departments for Home Affairs and Treasury and Resources. He is a member of the Chartered Association of Certified Accountants.

4. Recommendation

4.1. That the Minister of Education, Sport and Culture agrees that the two nominees identified above have the requisite experience, skills and background to act in the capacity of representatives of the Employer’s side of the Jersey Teachers’ Superannuation Fund Board of Management and approves their nominations accordingly.
