Road Traffic (St. Lawrence) (Jersey) Order 1990: Amendment: Law Drafting Instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

AMENDMENT TO ROAD TRAFFIC (ST. LAWRENCE) (JERSEY) ORDER 1990

 

 

Purpose of the Report

 

To amend the Road Traffic (St. Lawrence) (Jersey) Order 1990.

 

 

Background

 

A request has been received from the Connétable of St. Lawrence to amend the permitted vehicular access on La Ruelle de St Claire which is currently subject to a prohibition for Chars-á-Bancs and to change this to a restriction for vehicles exceeding 6 feet 6 inches in width.

 

The recent change to prohibition of waiting on La Rue de Haut which was approved as an Article 68 notice can also be formally Scheduled.

 

 

Discussion

 

The Connétable of St. Lawrence has requested that La Ruelle de St. Claire have the restriction for use by Char-á-Bancs replaced by a restriction for all vehicles exceeding 6 feet 6 inches in width as the road is unsuitable for these larger vehicles:

  • Remove the entry in Schedule 5 – Part 1 – Roads not to be used by Chars-á-Bancs for La Ruelle de St. Claire
  • Add to Schedule 5 – Part 3 – Roads not to be used by vehicles exceeding 6 feet 6 inches in width “La Ruelle de St. Claire (the entire road)”

 

The recent Article 68 notice adding an additional area of prohibition of waiting in La Rue de Haut also needs to be formally scheduled. A survey of La Rue de Haut has also shown there are a number of discrepancies between the current scheduled areas and what is actually in place so the existing Schedules should also be changed to reflect this:

 

  • La Rue de Haut Schedule 3 Part 1 – Prohibition of waiting:
  • Remove the entry “Both sides (from its junction with La Ruelle Corbel to the eastern boundary of the property known as “Little Grove”);
  • Add a new entry “North side (from its junction with La Ruelle Corbel to a point 74 yards east)”;
  • Add a new entry “South side (from its junction with la Ruelle Corbel to a point 64 yards further east)”;
  • Amend the entry “Both sides (from a point 50 yards east of its junction with Le Mont Cambrai to a point 80 yards west of its junction with Le Mont Cambrai)” to read “North side (from a point 75 yards west of its junction with Le Mont Cambrai to a point 147 yards east of its junction with Le Mont Cambrai)”;
  • Add a new entry to read “South side (from a point 75 yards west of its junction with Le Mont Cambrai to a point 222 yards east of its junction with Le Mont Cambrai)”;
  • Remove the following entries:
    • “South side (from its junction with Kimberley Grove to a point 240 yards east)”;
    • “South side (between its junction with St. Aubin’s Road and a point 18 yards north)”;
    • “South side (from a point 68 yards north of its junction with St. Aubin’s Road and a point 10 yards to the north of the northern boundary of the property known as “Ravenscrag”)”;
    • “North side (between its junction with St. Aubin’s Road and a point 60 yards to the north of the northern boundary of the property known as “Ravenscrag”)”;
  • Schedule 3 Part 1 – Prohibition of waiting, add the following:
    • “South side (from a point 239 yards east of the junction with Le Mont Cambrai to a point 7 yards further east)”;
    • “South side (from a point 251 yards east of the junction with Le Mont Cambrai to a point 27 yards further east)”;
    • “South side (from a point 282 yards east of the junction with Le Mont Cambrai to a point 13 yards further east)”;
    • “South side (from a point 381 yards east of the junction with Le Mont Cambrai to a point 75 yards further east)”;
    • “South side (from a point 461 yards east of the junction with Le Mont Cambrai to a point 6 yards further east)”;
    • “South side (from a point 473 yards east of the junction with Le Mont Cambrai to a point 22 yards further east);
    • “South side (from the junction with La Route de St Aubin to a point 5 yards west)”;
    • “North side (from the junction with La Route de St Aubin to a point 124 yards further west)”;
    • “North side (from a point 131 yards west of the junction with La Route de St Aubin to a point 4 yards further west)”;

    • Remove the entry “Between its junction with Le Mont Cambrai and its junction with St. Aubin’s Road”;

    • Add a new entry “South side (from a point 222 yards east of the junction with Le Mont Cambrai to a point 17 yards further east)”;
    • Add a new entry “South side (from a point 246 yards east of the junction with Le Mont Cambrai to a point 5 yards further east)”;
    • Add a new entry “South side (from a point 278 yards east of the junction with Le Mont Cambrai to a point 4 yards further east)”;
    • Add a new entry “South side (from a point 295 yards east of the junction with Le Mont Cambrai to a point 86 yards further east)”;

    • Add a new entry “South side (from a point 495 yards east of the junction with Le Mont Cambrai to a point 22 yards further east)”.

 

 

Conclusion

 

The change to La Ruelle de St Claire will change the restriction on the type and size of vehicles which can use this road in line with the request from the Connétable of St. Lawrence. Updating the currently Scheduled areas on La Rue de Haut to reflect what is actually in place will allow the Parish to police parking there.

 

 

Recommendations

 

The Minister is recommended to instruct Officers to issue Law Drafting instructions to amend the Road Traffic (St. Lawrence) (Jersey) Order 1990.
