Customs and Excise (Import and Export Control) (Amendment No. 2) (Jersey) Order 2012

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister made the Customs and Excise (Import and Export Control) (Amendment No.2) (Jersey) Order 2012.

Reason(s) for Decision: Amendment to the legislation is required following the introduction of Civil Partnership legislation.  The opportunity has also been taken to slightly amend some wording relating to widow and widower to make it more accessible.

Amendment to Schedule 3 of the Customs and Excise (Import) and Export Control) (Jersey) Order 2006

Background

As a part of an audit of legislation following the introduction of the Civil Partnership (Jersey) Law 2012 the Law Draftsman identified that Paragraph 3 of Schedule 3 of the Customs and Excise (Import and Export Control) (Jersey) Order 2006 required amendment.

In amending the Schedule the Law Draftsman also took the opportunity to tidy up the wording in relation to paragraph 3(c) regarding a widow/widower.

The original wording of the paragraph is attached as Appendix A.

The amended wording of the paragraph is attached as Appendix B.

Recommendation

It is recommended that the Minister approves and signs off the amendment drafted by the Law Draftsman.

Appendix A

 

3. Paragraphs 1 and 2 do not apply to –

(a) a birth, marriage or death certificate or other document relating to the personal affairs of the person who has exported it or the spouse of that person;

(b) a letter or any other writings written by or to the person who has exported the letter or writings, or the spouse of that person;

 (c)  any object exported by a person if –

(i) the object is the personal property of that person and has been manufactured or produced by that person, and

(ii) that person is not a company within the meaning of the Companies (Jersey) Law 1991,

Or the spouse, widow or widower of that person
