Milk and Dairies (General Provisions) (Jersey) Order 1992 - Amendment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Amendment to the Milk and Dairies (General Provisions) (Jersey) Order 1992.

Decision(s):

The Minister approved the Milk and Dairies (General Provisions) (Amendment) (Jersey) Order 2010 which removes the details of the Jersey Milk Marketing Board and the former dairy site from the Milk and Dairies (General Provisions) (Jersey) Order 1992.

Reason(s) for Decision:

To ensure that the Order provides appropriately for the new circumstances occasioned by the move of the dairy from Five Oaks.

Action required:

The Minister signs, dates and seals the Order.

Notify the Greffier of the States and the Law Draftsman that the Order has been made and forward the signed and sealed Order to the Publications Editor, States Greffe for notification to the States.

The Order is appropriately advertised in the Jersey Gazette.

TITLE: Amendment to the Milk and Dairies (General Provisions) (Jersey) Order 1992

Background  

Milk is a staple foodstuff of high calorific value and high nutrient level. Because of this it is also an ideal medium for the growth of disease organisms that can give rise to serious ill health and even death. Historically milk has also been the subject of poor practises with respect to adulteration and handling. In order to ensure that there are appropriate controls to maintain good standards on the husbandry of cows, premises, practises and distribution the above legislation was enacted under the Food Safety Law 1966. This requires the registration of all dairies and dairymen by the Minister for Health and Social Services. 

Under the legislation there is a requirement for all milk from cows to be processed at a central dairy run by the Jersey Milk Marketing Board.  

Issues  

In May 2010 the dairy moved from its original site at Five Oaks to new purpose built premises at Trinity. Under the existing legislation the original site was named within the legislation as the processing dairy. It is not entirely sure why this was undertaken as the general provisions of the Order are sufficient to ensure that the premises would have to be registered even if not named. The registration of the new premises has been undertaken in this way. 

The amendment to the law is to remove the references to the Jersey Milk Marketing Board and reference to the former site at Five Oaks which has been sold for development not related to dairying. 

The Economic Development Department have been consulted by the Law Draftsman concerning the changes to the Order and the Minister is content with the change. 

Financial Implications  

There are no financial implications 

Recommendation  

The Minister approves the amendment to the law which will remove the details of the former dairy site and the Milk Marketing Board from the existing legislation. The existing legislation already meets the needs for the definition of dairy and processing dairy to ensure the effective regulation of the new dairy site.
