Inclusion of Seymour Tower Car Park in Road Traffic (Public Parking Places) (Jersey) Order 2006.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  The Minister approved permission for the inclusion of Seymour Tower Car Park in the Road Traffic (Public Parking Places) (Jersey) Order 2006

Reason(s) for Decision:  The car park at Seymour Tower has been gifted to the Environment Department who have requested that the Parking Control Section of Transport and Technical Services Department administer its use.  This will require the car park to be scheduled in the Road Traffic (Public Parking Places) (Jersey) Order 2006.

TRANSPORT AND TECHNICAL SERVICES  

REQUEST FROM THE ENVIRONMENT DEPARTMENT TO SCHEDULE SEYMOUR TOWER CAR PARK IN THE ROAD TRAFFIC (PUBLIC PARKING PLACES) (JERSEY) ORDER 2006  
 
 

Purpose of the Report  

The Minister for Transport and Technical Services is asked to approve a request from the Environment Department to incorporate Seymour Tower Car Park in the Road Traffic (Public Parking Places) (Jersey) Order 2006. 
 

Discussion  

Ownership of the car park at Seymour Tower has been gifted to the Environment Department. It has requested that the Parking Control Section of the Transport and Technical Services Department undertake the administration of this car park on its behalf, whilst the Environment Department will remain responsible for its maintenance. 

In order to enable Parking Control to administer the car park it will need to be scheduled in the Road Traffic (Public Parking Places) (Jersey) Order 2006. A maximum stay period of 12 hours in any continuous period of 24 hours has been requested by the Environment Department. 
 

Recommendation  

The Minister is recommended to approve the request from the Environment Department and to instruct the Manager of Parking Control to arrange an amendment to the Road Traffic (Public Parking Places) (Jersey) Order 2006 to incorporate this.

To enable the Parking Control Section to administer the Seymour Tower Car Park on behalf of the Environment Department at its request.

To instruct the Manager of Parking Control to action the Minister’s decision.
