Building Bye-Laws (Jersey) 2007: Technical Guidance: Revised: Access and Use of Buildings

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Publication of revised technical guidance in support of the Part 2 requirements of Schedule 2 to the Building bye-laws (Jersey) 2007.

 

1.     Purpose of the Report.

 To seek the Minister’s formal approval of revised technical guidance to be  published in support the fire safety requirements of the building bye-laws. (See               attached).

 

  1. Background.

 On 19th December 2011, the Minister decided to approve the release of two draft               technical guidance documents – ‘Fire Safety in Dwellings Houses and Fire Safety               in Buildings Other Than Dwellings Houses for public comment. (MD-PE-2011-              0128). Those documents were published on the States website in December 2011               with a report outlining the proposals and inviting comments to be submitted by                    01 March 2012.

 

  1. Main changes in the revised Documents.

The guidance has generally been updated to reflect changes to British Standards, and to improve fire safety measures in buildings with a floor over 18m high and basement car parks by requiring the installation of sprinkler systems. A list of the main changes can be seen on the inside of the front cover to the Technical Guidance Documents. 

 

  1. Discussion on comments received.

 A summary of the findings of the consultation process is set out in Appendix 1.   There were only three completed questionnaires, therefore this cannot be               regarded               as statistically meaningful, or an accurate account of public opinion. The               completed questionnaires do show general support for the proposed changes,               although one respondent sought clarification on a number of points               relating to the               guidance on sprinkler systems. Each of the points raised has been addressed by               officer comments and none are considered sufficient to warrant any significant               changes to the draft guidance. (See Appendix 1).

 

  1. Legal and Resource Implications

 The Minister is empowered under Article 32 of the Planning and Building (Jersey)               Law 2002, to publish Technical Guidance for the purposes of providing guidance on               any requirement of the Building Bye-laws. There are no Departmental resource               implications arising from the publication of the documents. 

 

  1. Recommendation

 That the Minister:

  1. Endorses the response to the comments received, and authorises officers to publish this as a formal response to the consultation; and
  2. Publishes the revised Technical Guidance Documents, to take effect from 01/01/13, for the purposes of providing guidance on meeting the requirements in Part 2 of the second schedule to the building bye-laws (Jersey) 2007, as amended.
