A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister for Planning and Environment instructed the Law Draftman to prepare a new Order reflecting agreed increases to Planning and Building Application fees. PLANNING AND ENVIRONMENT

REPORT ON THE USER PAYS STRATEGY PROPOSALS FOR INCREASES IN PLANNING AND BUILDING FEES 2009 AND INCREASES TO ENVIRONMENT FEES AND CHARGES FOR 2009

Purpose of the Report

The purpose of this report is to seek the Minister for Planning and Environment’s approval to the proposed increases in fees and charges in 2009.

To agree that the appointment of additional professional and administrative staff to improve the Planning and Environment Department’s cores service, with the increased costs of doing so to be funded wholly by increases in application fees, and with the creation of additional posts to be subject to approval by the Minister for Treasury and Resources.

Discussion

In accordance with Finance Direction no 4.1, increases in States Fees and Charges above 2.5% require the approval of the Minister of Treasury and Resources.

The 2009 Business Plan, approved on 23rd September 2008, authorised the increase in charges which would target applications for commercial use and applications for residential development involving more than 5 dwellings, to enable the department to recruit to 9 additional posts.

Several of the Meteorology charges have been increased in excess of 2.5% for which justification has been provided in a note to the schedule of fees. The majority of these charges have increased as a result of trying to encourage customers to use e-mail delivery.

Recommendations

The Minister is recommended to approve the increases to the Department’s fees and charges as set out in the attached schedule and seek the approval of the Treasurer of the States to these increases over 2.5% in accordance with Finance Direction 4.1..
