Man Overboard Guardian Equipment: Funding for five fishing vessels

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: To approve funding towards the purchase of Man Overboard Guardian equipment for five fishing vessels.

 

Decision(s): The Minister to agree to contribute to the purchase of MOB Guardian, up to a maximum of £745 for five vessels registered in Jersey. The total budget is £3,725

Reason(s) for decision: In 2008 EDD agreed to contribute funding to a Man Overboard Safety system, equivalent to funding supplied by the UK government to UK registered vessels.

Resource Implications:  

The allocation of monies to fund the installation of MOB Guardian on Jersey vessels will come from existing funds held over in the Rural Initiative Scheme.

  Action required:  The Minister to instruct the Director EMRE to process the payments.

Provison of support to the fishing industry for the provision of Man Overboard Guardian safety system

 

Purpose of the Report

 

To approve monies towards the purchase of Man Overboard Guardian safety system for five Jersey registered fishing vessels.

 

Background

 

In 2008 EDD supported an initiative to fit local fishing vessels with new safety equipment that will activate if a man goes overboard. The system was part funded and monitored by the Royal National Lifeboat Institution (RNLI) via satellite. Funding was also supported by insurance companies and CIEG. If the system is activated, a central control centre will inform the local emergency services immediately, which in turn significantly aids the search effort and chance of rescue. 

 

Discussion

 

Since the initial application for funds for this system, five registered fishing vessel have fitted this equipment. Fishermen, through the Jersey Fishermen’s Association, have asked for a similar level of support to that given by the UK Government to UK fishermen for installation of this safety system Jersey registered vessels as agreed previously with the Department. The funding of this safety equipment is an consistent with the principle of matching support provided by the UK to its fishing and will come from existing RIS funds.     

 

Recommendation

 

The Minister is asked to agree to contribute the sum of £745 per vessel to the purchase of Man Overboard Guardian for five eligible vessels registered in Jersey. The total cost is £3,725.
