Education (Discretionary Grants - Amounts) (Jersey) Order 201-: Increase Level of Maintenance Grant: Law Drafting Instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Education (Discretionary Grants – Amounts) (Jersey) Order 20__  -  increasing the level of maintenance grant.

 

Decision(s):  The Minister agreed –

(a) that the level of maintenance grant for a standard course should be increased by £100 per year with a similar percentage increase to apply to other courses, and

(b) that the requisite instructions to enable preparation of the necessary draft Order should be submitted to the Law Draftsman.

 

Reason(s) for Decision:  The Education (Jersey) Law 1999 empowers the Minister ‘by order’ to make grants for students following programmes of higher education. The Orders describe the amount of States support available, how the level of support is assessed, the terms and conditions under which it is available and the criteria which students and their families must meet to be eligible. It has previously been agreed that the amount of grant for maintenance should be increased annually to reflect the annual increase in costs.

  1. Introduction

 

The financial support for students in Higher Education is made up of a grant for tuition fees and a grant towards maintenance i.e. living costs such as accommodation and travel.

 

 

  1. Background

 

After a number of years where there was no increase in the level of maintenance grant, in 2010 the Minister for Education, Sport & Culture agreed that there should be an increase of approximately 2% per year applied to the grant. For the academic year 1012/13 the level of grant stood at £5300 for a standard length course of approximately 32 weeks per academic year.

 

 

  1. Recommendation

 

For the academic year 2013/14 it is recommended that the level of maintenance grant increases to £5400 for a standard length course with the same proportionate increase being applied for non-standard courses. The Minister is asked to sign the attached Ministerial Decision to request the Law Draftsman to draft the Education (Discretionary Grants – Amounts) (Jersey) Order 20__.

 

The Minister is asked to note a further administrative correction to bring the maximum payable to a student taking a distance learning course in line with the increased level of course fees
