A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Increase in Fire and Rescue Service fees.
Decision(s): The Minister approved the increase in fees payable for services provided by the Fire and Rescue Service as detailed in the accompanying report and requested the Chief Fire Officer to liaise with the Law Draftsman over the drafting of the relevant Order to give effect to the fee increases.
Reason(s) for Decision: To enable the Department to increase the fees payable for fire certificates; the provision of technical fire safety advice; the provision of humanitarian services; the charge for attending a malfunctioning automatic fire alarm; and the fees payable under the Petroleum (Licensing) (Fees) (Jersey) Order 2012, in line with the States Anti-Inflation Strategy, detailed in Financial Direction 4.1: Increases in States’ Fees and Charges.

Introduction

This report identifies the current and proposed future fee increases proposed for 2015 in line with the States of Jersey Financial Direction 4.1 January 2006.

The average increase proposed is 2.5%, which falls within the Anti-Inflation Strategy in accordance with FD 4.1: Increases in States Fees and Services. The fees have been rounded to the nearest pence per square metre or pound in other cases as previously agreed by the Treasurer of the States.

Fee Increase Proposal

Following an annual review of the costs within the Jersey Fire and Rescue Service, it is proposed to increase the fees for certain services to help offset internal cost growth and running costs. Our proposed fee increases are shown highlighted in the text extracted from our existing fees orders below.

An additional charge will be made for any other expenditure incurred, including the costs of materials supplied or repairs to appliances and equipment that are directly attributable to the service rendered.

Resource Implications

Income generated from the above fees has been included in our budget and savings proposals for 2016 and there are no additional resource implications anticipated with these proposed increases.
