A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Planning and Environment:

  1. Confirmed his intention to List La Valeuse, La Rue de la Valeuse, St Brelade, as defined in the attached schedule as a Site of Special Interest under the provisions of Article 51(2)(b) Planning and Building (Jersey) Law 2002 by virtue of its special interest as described in the same schedule.
  2. Approved and authorised the serving of the Intention to List Notice in accord with the requirements of the Law.

Reason(s) for Decision:

  1. The special interest of La Valeuse, La Rue de la Valeuse, St Brelade, as defined and assessed relative to the published criteria for selection, justifies its inclusion on the List of Sites of Special Interest in accordance with the provisions and purposes of the Planning and Building (Jersey) Law 2002.
  2. It accords with the States Strategic Plan commitment of protecting and sympathetically managing the Island’s built heritage assets.

This report has been prepared by the Jersey Heritage Trust as part of its responsibility under a Service Level Agreement to provide reports and recommendations to the Minister for Planning and Environment on the registration of historic buildings and sites.

 

The Planning and Environment Department requested on 27 September 2007 that the Jersey Heritage Trust assess the architectural, historical and other interests of La Valeuse ahead of discussions with the Ministerial Registration and Listing Advisory Group.

La Valeuse was first registered in 1992 and was confirmed as a pSSI by the Jersey Building Heritage Sub-Committee on 23 July 2001.

 

La Valeuse is of special architectural and historical interest. The site includes a fine example of an intact Georgian farmhouse built in the mid-late 18th century, with associated outbuildings and garden.

 

The house is constructed of granite with dressed stonework to the window and door openings and quoins, and a date-stone ‘ELB 1766’ on the central sill. The windows are 12-pane sashes with windows of a diminishing scale to the first floor. The roof has raised verges, a pair of granite ashlar chimneystacks with thatch stones and original dormers. The former thatch has been replaced by pantiles. The interior of the house has a notable survival of contemporary joinery including an unusual dog-leg staircase with closed string and turned balusters, panelled dividing walls and fielded panel doors.

 

Associated buildings include a 4-bay extension on the west side of the house and a small square service building to the east. There is also a detached outbuilding built into the hillside to the east. To the front of the house is a garden with decorative iron gates and steps to the road.

 

Advice received (MRLAG or others)

 

MRLAG unanimously advised that La Valeuse be listed as a Site of Special Interest as set out in the schedule.  

 

JHT recommendation

 

La Valeuse should be listed as an SSI. It is recommended that the Minister for Planning and Environment approve the serving of the Intention to List Notice in accord with the requirements of the Law.

 

Justification relating to criteria

 

The listing of La Valeuse as an SSI is in accordance with the published principles for selection as follows:

 

·        The special interest of La Valeuse extends substantially to its authentic fabric, plan form and interior features.

  La Valeuse is of special interest for its architectural design, and the property illustrates a significant aspect of Jersey’s history.

 

The special interest of La Valeuse, as defined and assessed relative to the published criteria for selection, justifies its inclusion on the List of Sites of Special Interest in accordance with the provisions and purposes of the Planning and Building (Jersey) Law 2002.
