JCG and Langford Capital Projects - Inflation Allocation.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

  1. Introduction

 

The Minister is asked to accept the transfer of sums in respect of inflation from the capital reserve for the following projects:  

 Jersey College for Girls   £692,725

 Langford Sports Centre      £52,187 

The transfer has already been approved by the Minister for Treasury and Resources. 
 

  1. Background

 

Both of these projects commenced before individual inflation assessments were identified as part of the budgeting process in 1999. Prior to this date budgets were set on a ‘current cost’ basis and inflation claimed from the General Reserve.  

The General Reserve was abolished under the Public Finances (Jersey) Law 2005 and provision for the inflation sums on these schemes has been made in the Capital Reserve.  

The final accounts for both projects are complete, with all outstanding items relating to claims, fee payments and retentions now settled. The inflation funding requirement, effectively the ‘balancing figure’, has been established and budget transfers are required to close down the schemes within the financial ledger.  

The final account and inflation sums have been verified by the States Chief Quantity Surveyor.

 

  1. Comments

 

JCG - this has been an exceptionally complex scheme involving a number of interlinked projects and a lengthy claim in relation to the serpentine wall.

The final account position can be summarised as follows:  

Currently Approved Budget  £18,800,340

Inflation Sum Claimable £     805,190

Total Budget Claimable £19,605,530

Final Account Cost  £19,493,065

Net Underspend    £     112,465

Inflation Sum Required  £     692,725 
 

Langford - the final account has been delayed due to the resolution of ongoing defects. These issues are now resolved and retention sums due have been released.  

The Minister will recall that a funding transfer of £410,000 from the Langford Sport Centre capital budget to support the Education, Sport and Culture Department’s ICT replacement programme was approved under MD-TR-2006-0081 

The final account position, incorporating budget transfers, can be summarised as follows:
