Grouville Bay: Aquaculture concession: Jersey Oyster Company: Amendment of boundaries

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Approval to Alter the site boundaries of the Jersey Oyster Company Aquaculture Concession

 

 

Purpose of the Report

 

For the Minister to consider and approve an amendment to boundaries of the Jersey Oyster Company Shellfish growing concession on Grouville bay to reduce complexity and optimise area in use.

 

Background

 

The Minister issues licenses under the Sea Fisheries (Fisheries)(Jersey) Regulations 2010. The Jersey Oyster Company main concession in the Royal Bay of Grouville is the amalgamation and extension of two existing beds. This has resulted in an area of circa 40 ha that has six grid reference points defining its outline (a misshapen rectangle). The concession holder has asked that the site is realigned to simplify the area to just 4 corner points at the edges of the usable area.

 

Details

 

Oysters are farmed on grids of tables that are normally laid out on set patterns of double banked rows with access gaps. Below the oysters there are often also mussel poles allow for production in somewhat deeper waters at the very edge of the intertidal. The Current Jersey Oyster Company concession was formed by joining two adjacent farm sites into one. As the two did not exactly align this left a six-edged rectangle.

 

To simplify farming and access overall the JOC have requested the simplification of the bed. A move that will increase their holding by 0.4 ha. This will result in a continuous, straight sided concession area enhancing both management for the holder and control for officers.

 

 

Recommendation

 

The Minister is recommended to sign the updated license.
