Shipping (Safety Code - Yachts and Small Ships) (Jersey) Regulations 2013, and Shipping (Survey and Certification) (Jersey) Order 2013: Delegation of Functions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister decided to amend the delegation of functions previously stipulated in R.25/2012 as a consequence of where certain Shipping legislation has recently been repealed and replaced.

 

Reason(s) for Decision:

On 19 November 2013 the States adopted the Shipping (Safety Code – Yachts and Small Ships) (Jersey) Regulations 2013 and on 21 November 2013 the Minister made the Shipping (Survey and Certification) (Jersey) Order 2013. These respectively repealed and replaced the Shipping (Safety Codes) (Jersey) Order 2005 and the Shipping (Survey and Certification) (No.2) (Jersey) Order 2005.

 

As a result the delegation of functions authorised in R.25/2012 must be replaced by ones that refer to the correct legislation. A table of changes is attached.

 

Resource Implications:

There are no new financial, property, ICT or human resources issues arising.

 

Action required:

Following the preparation of the revised ‘Delegation of Functions’ Report by the initiating department, the Greffier of the States to be requested to arrange for the Report to be presented to the States for their information.

Delegation of functions – Consequential Changes

 

Report

 

 

Background

 

Following public elections and the subsequent appointment of a new Ministerial team in December 2011, a set of revised delegated functions for the Economic Development Department was published as R.25/2012.

 

On 19 November 2013 the States passed the Shipping (Safety Code – Yachts and Small Ships) (Jersey) Regulations 2013 and on 21 November 2013 the Minister made the Shipping (Survey and Certification) (Jersey) Order 2013. These respectively repealed and replaced the Shipping (Safety Codes) (Jersey) Order 2005 and the Shipping (Survey and Certification) (No.2) (Jersey) Order 2005.

 

As a result the delegation of functions authorised in R.25/2012 must be replaced by ones that refer to the correct legislation.

 

 

Considerations

 

In drawing up the new delegation of functions close consideration was given to the limits and constraints placed on the power to delegate under Article 28 of the States of Jersey Law 2005. These limits ensure no officer has the power to make a legal enactment, to decide an appeal under such enactments or to do anything prohibited. At all times the Minister retains the power to exercise the delegated functions himself.

 

The functions delegated concern professional maritime matters and care has been taken to ensure they are not of a political nature. Consistency and accuracy of statutory references has been maintained and in effect the functions replicate those that existed under the repealed legislation. The persons delegated remain as previously nominated.

 

 

Conclusions

 

The changes to the existing delegations are shown in the attached table.
