A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Variation of Conditions No.1 & No.3 - (Homebuy) to alternative affordable housing mechanism for Planning Permit P/2006/2648.

Decision(s):

The Minister for Planning and Environment has agreed to vary Conditions 1 & 2 from Planning Permit P/2006/2648 whereby the ‘Homebuy’ requirements are removed from the Permission to be replaced with an affordable first time buyer scheme.

 

The amendment was agreed following discussions and legal advice received by the Minister on the 27th October 2011 regarding the inability of the States Assembly to provide a suitable mechanism to deliver the “Homebuy Scheme”.

Reason(s) for Decision:

This decision has been reached so that the sale of 6 new houses can be proceed following the failure of the States Assembly to reach agreement on a suitable mechanism to deliver the “Homebuy” scheme.   Further, the site remains within the Built-Up Area as defined by the Island Plan, 2011.  Policy H6 outlines the Plan’s intention to deliver the majority of the Island’s housing supply from development within the Built-Up Areas.  Therefore, notwithstanding the sites previous Category ‘A’ status, under the current Island Plan the site remains a viable development site capable of delivering ‘first time’ buyer housing.

 

The replacement of Conditions 1 & 3 to the original Permit P/2006/2648 reads as follows:-

 

Condition(s)

1. The six units numbered 4 to 9 inclusive ("the units") constructed at the development (as shown approximately on the area highlighted in pink on Planning Approved Drawing RC/2011/1376 'A') shall not be occupied until a scheme for their occupation as affordable first time buyer housing as part of the development has been submitted to and approved in writing by the Minister for Planning and Environment.

 

The units shall be provided in accordance with the approved scheme.  The scheme shall include:-

i.    the arrangements for the transfer of the units to nominated buyers;

ii.   the arrangements to ensure that such provision is affordable to the occupiers of the units; and

iii.  the occupancy criteria to be used for determining the identity of occupiers of the units and the means by which such occupancy criteria shall be enforced.

2. The Planning Obligation Agreement referred to in Condition 1 of the original Planning Permit P/2006/2648 shall now be modified to reflect changes consequent upon Condition 3 as varied following application RC/2011/1376.

1. To ensure that the development is carried out and completed in accordance with the details approved by the Minister for Planning and Environment to accord with Policies H3 & H6 of the Island Plan, 2011.

Resource Implications:  Planning Officer to issue Planning Permit RC/2011/1376 to reflect revised conditions to original Planning Permit P/2006/2648.
