Policing of Parks (Amendment No.3) (Jersey) Regulations 201-: Lodging

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Policing of Parks (Amendment No. 3) (Jersey) Regulations

Decision(s): The Minister approved the Policing of Parks (Amendment No. 3) (Jersey) Regulations amendment to the commencement date change from 15 October 2011 to 02 November 2011 and directed officers to arrange for the Regulations to be lodged ‘au Greffe’ for debate by the States forthwith.

 

Reason(s) for Decision: The date for the enforcement of the Policing of Parks regulations cannot be retrospective and 02 November 2011 is the earliest possible date where the regulations can come into force.

AMENDMENT TO THE POLICING OF PARKS (JERSEY) REGULATIONS 2005

 

 

Purpose of the report

 

For the Minister to approve an amendment to the amendment of the Policing of Parks (Jersey) Regulations 2005 relating to the commencement date for the regulations coming into force.

 

Background

 

The Minister for Transport and Technical Services has agreed to an amendment to the above Regulations with regard to the commencement date for the regulations in relation to the policing of the Millennium Town Park.

 

Discussion

 

Millennium Town Park was opened on 29 October 2011. However, due to pressures on States business the debate day for the regulations was delayed and we have amended the day in which the regulations come into force to be 02 November 2011.

 

Recommendation

 

The Minister approves the Policing of Parks (Amendment) (Jersey) Regulations and directs officers to arrange for the matter to be lodged ‘au Greffe’ for debate by the States at the earliest opportunity.

 

 

Reason(s) for Decision

 

Amend the amendment of the Policing of Parks (Jersey) Regulations 2005 to change the date for the regulation coming into force from 15 October 2011 to 02 November 2011.
