The Tourism Jersey Law 1948: Exemption From Duty To Register - Jersey Blind Society

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister, acting in accordance with Article 7(2) of the Tourism (Jersey) Law 1948, approved the exemption from the duty to register to the Jersey Blind Society, Westlea Centre, St Martin.   

Reason(s) for Decision:

This exemption will preclude the Jersey Blind Society, Westlea Centre, to be registered under the Tourism (Jersey) Law 1948.  This exemption has been granted as the establishment carried on by the organisation is not conducted for profit. 

Resource Implications:

No resource implications arising from this decision.  

Action required:

The Hospitality and Leisure Manager to notify the Jersey Blind Society, Westlea Centre, that the granting of the exemption will now not make it necessary for them to be registered under the Tourism Law.

Exemption From Duty To Register Under The Tourism (Jersey) Law 1948 – The Jersey Blind Society, Westlea Centre, St Martin.

 

Issue

 

This decision effectively reinstates the exemption previously placed upon the Jersey Blind Society which exempted it from registering under the Tourism (Jersey) Law 1948.

 

In June 2010 a ministerial decision was made, MD-E-2010-0104, to withdraw the exemption from duty to register under the Tourism (Jersey) Law 1948 to the Jersey Blind Society. 

 

This original decision would have allowed it to make itself more available to a wider audience and taking advantage of the additional marketing opportunities which is enjoyed by registered establishments.

 

Following a meeting of the Blind Society in early 2011 it was decided that the additional expense that would be incurred, to bring the Westlea Centre in line with current regulations, would not make it viable to promote the centre as a commercial guest house relative the amount of persons that could be lodged on the premises.

 

It is now necessary to reinstate the original exemption outlined in article 7(1)a of the Tourism Law.  This exemption grants any establishment carried on by an organisation not conducted for profit  from the provisions of Article 5a, duty to register,                

  

Recommendation

 

It is recommended that the Minister grants the exemption therefore not making it  necessary for the Jersey Blind Society, Westlea Centre, to register under the Tourism (Jersey) Law 1948. 

 

Action

 

On approval of the granting of the exemption the Hospitality and Leisure Manager will notify the Jersey Blind Society and advise that it is not necessary for it to register under the Tourism Law.
