Road Traffic (Public Parking Places Charges) (Amendment) (Jersey) Order 2011

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister made the Road Traffic (Public Parking Places - Charges) (Amendment) (Jersey) Order 2011, to become effective on 01 February 2011.

Reason(s) for Decision: Further to MD-T-2010-0121 and MD-T-2010-0133 enabling preparation of the Road Traffic (Public Parking Places - Charges) (Amendment) (Jersey) Order 2011 the proposed amendments are reasonable and justified.

Resource Implications: Stock check on all retailer held stock by Imperial Civil Enforcement £4,500. Production of new window stickers for retailers £300. JEP advert £100.

Action Required: To notify the Greffier of the States and the Law Draftsman that the Order has been made and forward the signed and sealed Order to the Publications Editor, States Greffe, for notification to the States.

ROAD TRAFFIC (PUBLIC PARKING PLACES – CHARGES) (AMENDMENT)

 

(JERSEY) ORDER 2011

 

 

Purpose of the report

 

To request the Minister to make the Order to introduce the previously approved increases in parking charges and to add Ann Place Car Park to the areas where Season Tickets can be used.

 

Discussion

 

On 26 November 2010, the Minister for Transport and Technical Services approved a request to increase the Department’s fees and charges for Jersey Car Parking (MD-T-2010-0121) and requested the Law Draftsman to amend the Road Traffic (Public Parking Places – Charges) (Jersey) Order 2010 to incorporate the increases as set out in the Appendix to the previous report. In summary, the Minister agreed to increase the cost of scratchcards and season tickets by 2% as required to maintain current income levels.

 

The increases have been approved by the Minister for Treasury and Resources.

 

The Minister for Transport and Technical Services also approved the introduction of Ann Place Car Park as an area where Season Tickets would be valid (MD-T-2010-0133) and this has been added in this Amendment.

 

Recommendations

 

The Minister is recommended to approve the Road Traffic (Public Parking Places – Charges) (Amendment) (Jersey) Order 2011 to be effective from 01 February 2011.

 

Reason (s) for Decision

 

To enable Jersey Car parks to increase its fees and charges as is required to maintain current cost recovery levels and to add Ann Place Car Park.  Further to MD-T-2010-0121 and MD-T-2010-0133 enabling preparation of the Road Traffic (Public Parking Places - Charges) (Amendment) (Jersey) Order 2011 the proposed amendments are reasonable and justified.
