Manual Workers' Joint Council - Employers' Side Membership.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Chief Minister, having endorsed the recommendation of the States Employment Board concerning membership of the Employer’s side of the Manual Workers’ Joint Council for 2008, approved the report and proposition entitled, ‘Manual Workers’ Joint Council: Employer’s Side Membership’ and agreed that it should be lodged ‘au Greffe’ with a view to securing the earliest possible date for debate.

Reason(s) for Decision:

In accordance with its Act of 1961, as amended in 2006, the States need to appoint their representatives on the Employers’ side for 2008

MANUAL WORKERS’ JOINT COUNCIL

EMPLOYERS’ SIDE MEMBERSHIP  
 

The States Employment Board (SEB) is advised that the Employers’ Side membership of the Manual Workers’ Joint Council (MWJC) comprises four representatives of the States and one representative of the Constables of Jersey.  

The Employers’ Side membership of the Manual Workers’ Joint Council for 2007 was: 

  • Deputy Ian Gorst (Deputy of St Clement)
  • Deputy Alan Maclean (Deputy of St Helier)
  • Mr John Michael Pollard (Chief Executive, Health and Social Services)
  • Mr John Richardson (Chief Executive Officer, Transport and Technical Services)

 

For information, the representative of the Constables is Constable Simon Crowcroft, Constable of St Helier. 

It is proposed that the membership of the Employers’ Side of MWJC for 2008 should be: 

  • Deputy Ian Gorst (Deputy of St Clement)
  • Senator James Perchard
  • Mr John Michael Pollard (Chief Executive, Health and Social Services)
  • Mr John Richardson (Chief Executive Officer, Transport and Technical Services)

 

If the SEB is in agreement with this, it is asked that the attached proposition be put to the States at the earliest opportunity.

The States are asked to decide whether they are of opinion – 

In accordance with their Act dated 9th November 1961, as amended, concerning the membership of the Manual Workers’ Joint Council, to appoint the four representatives of the States to serve as members of the Employers’ Side of the Council for 2008, as follows – 

Deputy Ian Joseph Gorst of St. Clement

Senator James Perchard

Mr John Michael Pollard, Chief Executive, Health and Social Services

Mr John Richardson, Chief Executive Officer, Transport and Technical Services

Explanatory Note 

The Employers’ Side membership comprises four representatives of the States and one representative of the Connetables. 

The Employers’ Side represents the Executive in negotiations with the Transport and General Workers Union on Manual Workers’ pay and conditions of service.  The nominations for the States’ representatives have been based on the fact that they are either Assistant Ministers or Chief Officers of departments employing significant numbers of Manual Workers. 

Deputy Alan MacLean served on the Council in 2006 and 2007 and the States Employment Board is grateful to him for his service during this period. It is because he does not wish to continue that the Board seeks to appoint Senator Perchard, who is Assistant Minister for Health and Social Services, the States’ largest employing department.
