Health Care (Registration) (Jersey) Law 1995 - Proposal to remove names from the register

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  The Minister for Health and Social Services has approved the removal from the Health Care Register those people listed in Appendices 1, 2 and 3 in the attached report dated the 07 January 2011.

Reason(s) for Decision:  (i) To confirm the request by those in Appendix 1 to remove their names from the Health Care Professionals register

(ii) The failure of the persons listed in Appendix 2 to make an application to the Minister for Health and Social Services to continue operating as Health Care Professionals as required by Article 5(2) Health Care (Registration) (Jersey) Law 1995 as amended

(iii) Failure of the persons listed in Appendix 3 to hold the prescribed qualification required under Article 3(1)(b) of the Health Care (Registration) (Jersey) Law 1995 as amended.

Action required:  Written notification by the Acting Medical Officer of Health to those listed in Appendices 1, 2 and 3 that their removal from the Register of Health Care Professionals has been confirmed by the Minister for Health and Social Services.

TITLE: Health Care (Registration) (Jersey) Law 1995 - Proposal to remove names from the register

 

 

Statutory Framework

 

It is a requirement of the Health Care (Registration) (Jersey) Law 1995 as amended, that people engaged in occupations relating to health care are registered by the Minister of Health and Social Services.  Those who are registered are thereafter required to renew the registration annually under Article 5(2) which states:

 

“An application for renewal of registration shall be made in the month of December and, if the application is not made in that month, the Committee may direct that the name of the registered person be removed from the register.”

 

The legislation further states under Article 5(1):

 

An application for registration or renewal of registration shall-

 

(a) be in the form required from time to time by the Committee;

 

(b) contain or be accompanied by such particulars as the Committee may require;

 

(c) be verified in such a manner and to such an extent as the Committee may require”

 

Article 3(1)(b) sets out the qualifications for registration

 

“Subject to the provisions of this Law, a person shall be entitled to be registered in respect of a registrable occupation if he or she satisfies the Minister that  (b) he or she holds a prescribed qualification;”

 

 

Annual Renewal Procedure

 

A renewal application form and letter was sent to all those on the Register in October 2010.  A follow-up letter, explaining the requirement that the completed application form must be received by 31st December 2010, was sent to those who had not responded in November 2010.  This letter specified that if the application to renew was not received by the required date, that the Minister for Health may direct their name to be removed from the register. 

 

By the beginning of January 2010, there were 23 people who contacted the department, in writing, to ask for their name to be removed from the register.  96 people made no contact with the department regarding renewal of their registration; all were confirmed as not working for H&SS, the majority of whom are thought to have left the Island. 

Following a routine check 3 applicants for registration were no longer registered with the NMC, therefore do not hold the prescribed qualification and are ineligible for registration for 2011.

 

In accordance with the Health & Social Services Committee decision in September 2005 regarding the procedure for re-registration, a letter was sent to all non responders and ineligible applicants by recorded delivery, on 06 January 2011 informing them that they are not registered for 2011 in accordance with previous advice of Crown Advocate, Sally Sharpe.  The decision to remove a registrants name from the register however remains with the Minister.

 

Recommendation:

 

The Minister is asked to approve the removal from the Health Care Register the people listed in Appendices 1, 2 and 3.
