Civil Partnership (Jersey) Law 201- Amendments to Associated Legislation

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Consequential amendments flowing from the draft Civil Partnership (Jersey) Law 201-  to:

-          Companies (Jersey) Law 1991,

-          Banking Business (Jersey) Law 1991, and

-          Financial Services (Jersey) Law 1998.

 

Decision(s):

 

In the event that the States adopt the draft Civil Partnership (Jersey) Law 201-, the Minister has agreed the following consequential amendments:

 

-          Companies (Jersey) Law 1991 (Articles 58A(9)(b), 123(7), 176B(2)(a) and (b), 176B(4) and 210)

-          Banking Business (Jersey) Law 1991, (Articles 1(a) and 2(5)(a) and (c)) and

-          Financial Services (Jersey) Law 1998  (Article 1(1)(a), paragraph 9(2)(b) of Schedule 2 and the note following paragraph 11(c) of Schedule 2)

 

Reason(s) for Decision:

 

The Chief Minister intends to lodge the draft Civil Partnership (Jersey) Law 201-. 

 

Paragraph 5 of Schedule 4 of the draft Law details consequential amendments to the Companies (Jersey) Law 1991.  Paragraphs 25(3) and 25(5) of Schedule 4 of the draft Law detail respectively the consequential amendments to the Banking Business (Jersey) Law 1991 and the Financial Services (Jersey) Law 1998.

 

In each case, the respective amendments seek to provide, as far as possible, for civil partners to be treated in the same way as married couples.

 

As the Economic Development Minister is responsible for these three Laws, it is necessary for him to endorse the proposed amendments.

 

Resource Implications:

 

There are no financial or manpower implications arising as a result of this decision.

 

Action required:

 

The Chief Minister’s department will be informed of the Minister’s agreement.
