Planning Applications Panel Membership Nominations - Report and Proposition.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):   The Minister approved the draft report and proposition nominating the Constable of St John, Deputy P. Le Claire and Deputy J. Maçon as members of the Planning Applications Panel for a period of three years.

Planning Applications Panel - Membership  

THE STATES are asked to decide whether they are of opinion: -  

to appoint, in accordance with Article 9A(2) of the Planning and Building (Jersey) Law 2002, as amended, the following persons as members of the Planning Applications Panel for a period of three years with immediate effect– 

  1. Constable Graeme Frank Butcher of St John;
  2. Deputy Paul Vincent Francis Le Claire of St Helier; and
  3. Deputy Jeremy Martin Maçon of St Saviour

 

Minister for Planning and Environment 

Report 

The Planning and Building (Jersey) Law 2002 provides that there should be a Planning Applications Panel comprising up to nine States Members and that its members will be appointed by the States on the nomination of the Minister for Planning and Environment. Following the retirement from the States of the former Constable of St Peter, there are three posts available to fill. 

The existing members of the Panel are Deputy A. Pryke (Chairman), the Constables of St Mary, Trinity and St Saviour, and Deputies C. Egré and S. Power. 

I am delighted to nominate the Constable of St John for membership of the Panel. His experience in managing a rural parish will be invaluable. 

Similarly, I am delighted to nominate Deputies P. Le Claire and J. Maçon. Both Deputies represent urban districts and will provide balance to the Panel. 

Please note that the Law allows for nominations only to be made by the Minister.  If the States rejects these nominations, the Minister can nominate another States member, and so on, until the vacancies are filled.   

There are no financial or manpower implications arising from this proposal
