Overseas Aid Commission: Approval of payment of aid

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

 The Minister approved the payment of an53 applications for overseas aid, amounting to £149,311, agreed by the Overseas Aid Commission at their meetings on 1825th October 2010 and 4th November 2010..approved the transfer of the Comprehensive Spending Review Team budgets and manpower from the Chief Minister’s Department to the Treasury and Resources Department with effect from 1 January 2010, along with all balances and transactions as at the date of transfer.  These comprised non-recurring budgets of £740,000 and a recurring budget of £76,600 and 1.0 FTE.

 

Reason(s) for Decision:

To approve the payment of overseas aid pending the appointment of an Accounting Officer to the Overseas Aid Commission.The Comprehensive Spending Review  (CSR) Team was set up under the Chief Minister’s Department to undertake the CSR in 2010. The Treasury is currently undergoing a restructure, part of which includes the creation of a Financial Planning Team, which is primarily a continuation of the CSR team beyond its original duration of 6 months. The transfer reflects the change of accountability for this new team.

 

 

Resource Implications:

Payment of expenditure of £149,311 from the Overseas Aid Commission budget; the remaining budget for 2010 currently amounts to approximately £204,000.Payment of expenditure of £3014919,000311 from the Overseas Aid Commission budget.

 There is no overall increase to States Spending or manpower as a direct result of this decision which concerns the transfer of carry forwards which are non-recurring and 1 existing post.

 

However, the continuation of the Financial Planning team into 2011 is part of the overall Treasury restructure which is the subject of a growth bid of 6.00 FTEs and £550k as part of the 2011 Business Plan/Comprehensive Spending Review.

 

Action required: 

Head of Decision Support to request Tthe Head of Shared Services to make payments as directed by the Overseas Aid Commission.ransfers to be actioned by Acting Finance Director – Corporate Group and Head of Financial Planning.

Jersey Overseas Aid Commission (“joac”) – Aid Payments NOVEMber 2010

 

 

  1. Purpose of Report

The purpose of this Report is to document the approval by the Minister for Treasury and Resources of overseas aid payments amounting to £149,311.

 

  1. Background

The JOAC receives funding from the States of Jersey on an annual basis. Whereas the JOAC makes decisions in respect of overseas aid funding, the Interim Treasurer of the States recommended in August 2010 that, in the absence of an Accounting Officer for the JOAC, the Minister for Treasury and Resources should authorise all overseas aid payments.

 

  1. JOAC proposed payment

The JOAC met on 25th October and 4th November 2010 and approved the following overseas aid payments:

  • £30,000 to UNICEF for severe flood relief in Benin;
  • £29,311 to Save the Children, UK for flood relief in Central Vietnam;
  • £30,000 to Christian Aid for emergency aid (cyclone) in Burma;
  • £30,000 to plan for severe flood relief in Benin;
  • £30,000 to plan for emergency aid relief (tsunami) in Mentawai Islands, Indonesia.
  1. Recommendation

The Minister for Treasury and Resources approves the above payments.

 

  1. Reason for Decision

Ratification of decisions taken by the JOAC to make overseas aid payments as set out above.
