Amend the Road Traffic (Speed Limits) (Jersey) Order 2003.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister approved the proposals to extend the 30mph speed limit at St Lawrence School and remove the 30mph speed limit at Trinity School.

Reason(s) for Decision:  To allow adjustments to the speed limits outside Trinity and St Lawrence Schools, to enable the installation of part time 20mph speed limits at those locations.

Resource Implications:    The part time 20mph speed limits are being funded from the Community Safety Fund. Law Drafting time will be required.

Action required: The Department are to write to the Law Draftsman to request the drafting of the necessary amendments for signing by the Minister at the appropriate time.

Amendments to the Road Traffic (Speed Limits) (Jersey) Order 2003

to Allow Installation of Part Time 20mph Speed Limits  
 

Purpose of the Report  

To amend the Road Traffic (Speed Limits) (Jersey) Order 2003 
 

Background  

The Minister recently instructed the Department to make the necessary arrangements to install part time 20mph speed limits on the roads outside nine Jersey primary schools.  As part of the arrangements to introduce part time 20mph speed limits at Trinity School and St Lawrence School, it is necessary to amend the Road Traffic (Speed Limits) (Jersey) Order 2003. 
 

Discussion  

La Route de la Trinité at Trinity Primary School  

Following a recent instruction to introduce part time 20mph speed limits at various primary schools the Department is now working through the details to implement the proposals.  La Route de la Trinité for a short distance immediately either side of Trinity School is currently subject to a 30mph speed limit.  The speed limit has been placed here specifically for the school, but has not proved to be effective at slowing vehicles down. 

It is considered appropriate to remove the 30mph speed limit which is not respected, and install what is expected to be a more respected part time 20mph speed limit. The part time 20mph speed limit will operate every day during term time, from 0800 to 0915 in the mornings, from 1430 to 1530 in the afternoons, and at such times during the day when pupils are walking to and from the playing fields. 

With the part time speed limit in place for the school, the 30mph speed limit will become superfluous and should be removed. The Parish and School have both been consulted on these proposals and are supportive. 
 

La Grande Route de St Laurent at the Parish Church, School and Hall  

La Grande Route de St Laurent is subject to a 30mph speed limit in the vicinity of a Public House, a shop, tearooms, the Church, the Parish Hall and the School. The 30mph speed limit is therefore required to be in place at times other than when the school requires it.  The northern extent of the speed limit currently ends approximately at the boundary of the school, which means the proposed location of the part time 20mph speed limit will end outside the current 30mph speed limit.

It is considered appropriate to locate the part time 20mph speed limit wholly within the 30mph speed limit. To achieve this it is necessary to move the northern end of the existing 30mph speed limit at this location north by 300m, to a point just beyond the junction with La Rue Milbraie, and into La Rue de Corvée as far as Mont de la Chesnaie.   

The Parish has previously requested an extension to the speed limit and remains supportive of the proposal.   
 

Conclusion  

Trinity  

The existing 30mph speed limit on La Route de la Trinité outside Trinity School should be removed once the part time 20mph speed limit has come into operation. 

St Lawrence  

The 30mph speed limit at St Lawrence should be extended north by 300m before the part time speed limit at St Lawrence School is installed. 
 

Recommendation  

The Minister is recommended to approve the proposals to extend the 30mph speed limit at St Lawrence School and remove the 30mph speed limit at Trinity School.

Action Required
