Fort Regent Political Steering Group - interim report

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  On 20th January 2010 the States adopted P188/2009 as amended which requested the Minister for Education Sport and Culture to establish and lead a political steering group with the aim of producing a cohesive and realistic plan for the future development of Fort Regent and to provide quarterly updates to all States members of its progress.

Decision(s): The Minister approved the report dated 20th May 2010 and decided to present it to the States.

Reason(s) for Decision:  To meet the terms of P188/2009: “Fort Regent: Establishment of a Working Group”.

Fort Regent Political Steering Group

Introduction  

On 20th January 2010 the States, in adopting proposition P.188/2009 of the Education and Home Affairs Scrutiny Panel, as amended, agreed to request the Minister for Education, Sport and Culture – 

‘(a) to establish and lead a political steering group, consisting of representatives from the Education, Sport and Culture Department, Jersey Property Holdings, the Economic Development Department, the Planning and Environment Department, the Parish of St. Helier and at least one States Deputy of St. Helier No. 1 District, who would consult with other interested parties including the Jersey Heritage Trust and the Fort Users Association, with the aim of producing a cohesive and realistic plan for the future development of Fort Regent; and  

(b) to take the necessary steps to form the political steering group immediately and to provide quarterly updates to all States members of its progress regarding the formulation of a development plan for Fort Regent.’  
 

Membership  

On February 15th 2010 the Steering Group met for the first time and agreed its membership as:

The Steering group is supported by officers from Education Sport and Culture, Economic Development, Planning and Environment, Property Holdings and the Parish of St Helier. 

Terms of Reference  

In order to meet the aim of producing a cohesive and realistic plan for the future development of Fort Regent Terms of Reference were agreed as follows: 

1:

Consider previous reports undertaken on Fort Regent, including any work undertaken by departments such as Jersey Property Holdings;

2:

Identify key issues requiring further investigation and develop vision

3:

Explore options for any future development with both the private sector and other interested parties;

4:

Agree on priorities or a phased approach for any future developments;

5:

Consider the impact any future development may have on the surrounding area, having regard to current and recent reviews, including the Island Plan review and the North St. Helier Master Plan;

6:

Identify the resource implications associated with any proposals; and

7:

Produce a draft master plan for Fort Regent and surrounding area with appropriate consultation.

 
 

Meetings 

The group has met on three occasions and has also had a site visit to Fort Regent. Officers from Education Sport and Culture, Planning and Environment, Economic Development and Property Holdings have made presentations to the group about operation and policies which affect Fort Regent and any possible developments. In addition, the group have been provided with all relevant reports which have been produced in recent years.
