Pilotage Dues increase for 2009.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The Minister made the Pilotage (Dues and Fees) (Jersey) Order 200-

Reason(s) for Decision:

In order to meet its obligations as a States Trading Operation and under legislation relating to shipping and sea navigation, Jersey Harbours raises charges for the use of port facilities. The Minister concluded that those charges should be increased by RPI(Y) of 3.9% with effect from 1st January 2009. 

The schedule of charges attached implements the decision of the States of Jersey to approve the Jersey Harbours Business Plan 2009. (MD-E-2008-0167)

Pilotage Dues increase for 2009.

Pilotage (Dues and Fees) (Amendment) (Jersey) Order 200-

Explanatory Note

This Order increases the fees payable in relation to pilotage by 3.9%, except the charge for a pilots licence which is increased from £21.50 to £70.

The fees were last increased on 1st January 2008.

THE MINISTER FOR ECONOMIC DEVELOPMENT, in pursuance of Article 3 of the Pilotage (Jersey) Law 1988, and after consultation with the pilots nominated under Article 15 of that Law, orders as follows 

1 Schedule substituted

For the Schedule to the Pilotage (Dues and Fees) (No. 2) (Jersey) Order 2007 there is substituted the Schedule contained in the Schedule to this Order.

2 Citation and commencement

This Order may be cited as the Pilotage (Dues and Fees) (Amendment) (Jersey) Order 200- and comes into force on 1st January 2009.

for a ship 70 metres or more in length 

£2.44 for each metre or part of a metre of the length of the ship

 

(b)

between 2300 hours on one day and 0600 hours on the following day 

 

 

 

(i)

for a ship less than 70 metres in length 

£3.01 for each metre or part of a metre of the length of the ship

 

 

(ii)

for a ship 70 metres or more in length 

£3.67 for each metre or part of a metre of the length of the ship

2.

Waiting time in respect of a ship that is not ready to depart at the time for which a general pilot has been engaged 

 

 

(a)

for a period exceeding 30 minutes, but not exceeding 1 hour 

£61.26

 

(b)

for each succeeding hour or part of an hour

3.

Pilotage by a general pilot of a ship from one harbour to another in Jersey 

An amount equal to 135% of the dues calculated in accordance with Item 1

4.

The pilotage by a general pilot of a ship within the territorial waters of Jersey that returns to its harbour of departure 

An amount equal to 175% of the dues calculated in accordance with Item 1

5.

The services of a general pilot to move a ship in harbour from one berth to another 

An amount equal to 30% of the dues calculated in accordance with Item 1

6.

The services of the pilot where a ship under the pilotage charge of a general pilot anchors in the roads and later enters harbour under pilotage

for the pilotage 

An amount equal to 150% of the dues calculated in accordance with Item 1

 

(b)

for each boarding of the ship by the pilot

The boarding of a ship bound inwards by a general pilot to take pilotage charge

A minimum amount of £275.57 for the first 3 hours and £91.86 for each hour of the following 6 hours and £137.79 for each subsequent hour, with any part of an hour being counted as a whole hour, plus, where (b) applies, reasonable travelling expenses

 

(a)

the day the pilot is returned in the ship to the place where the pilot was taken on board; or

 

(b)

if the pilot is discharged from the ship at a distance from the place where the pilot was taken on board - when the pilot has had sufficient time to return to that place
