Weights and Measures (Amendment of Schedules 2 and 3 to Law) (Jersey) Order 2014

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  The Minister made the Weights and Measures (Amendment of Schedules 2 and 3 to Law) (Jersey) Order 2014

 

Reason(s) for Decision: There are two reasons for this Decision:

(1) to make the imperial capacity measure of two-thirds of a pint a quantity lawful for use for trade;    

(2) to make two-thirds of a pint a lawful quantity for the sale of draught beer and cider.

Resource Implications: There are no resource implications as a result of this decision.

 

Action required: The Greffier of the States to be requested to arrange for the making of the Weights and Measures (Amendment of Schedules 2 and 3 to the Law) (Jersey) Order 2014 to be notified to the States and the signed and sealed Order to be delivered to the Publications Editor, States Greffe.

Amendments to Schedules 2 and 3

 

 

 

 

Background

 

In 2011 the United Kingdom government introduced various amendments to its

Weights and Measures legislation. Included among these was the introduction of a new legal measure of two-thirds of a pint for the sale of draught beer and cider. Following this the Minister consulted with the local licensed trade which was unanimous in agreeing that a similar size should be legally available in Jersey.

 

Part of achieving that objective requires an amendment to Schedules 2 and 3 of the Weights and Measures (Jersey) Law 1967. The amendment to Schedule 2 provides for the imperial capacity measure of two-thirds of a pint to become a quantity that is lawful for use for trade. The amendment to Schedule 3, which deals with the sale of draught beer and cider, introduces two-thirds of a pint as a legal quantity for the dispensing of those products by licensees.

 

 

Recommendation 

 

It is recommended that the Minister approves the attached amendment Order and authorises it to be laid before the States once it is signed and sealed.
