States of Jersey 2005: Delegation of Functions: Minister for Social Security: Extension September 2020

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Social Security Minister extension - delegation of functions in response to Covid19 (Coronavirus).

Decision(s): In addition to ongoing ministerial delegations the Minister for Social Security signed MD-S-2020-0036 on 23 June 2020, due to Covid19 (Coronavirus), to maintain continued efficient administration. This delegation extended the previous Covid19 related decision (MD-S-2020-0017) until 30 September 2020.  Having now reviewed this decision the Minister has decided to further extend the delegations detailed below from 1 0ctober 2020 for another 6-month period until 31 March 2021 (subject to review):

1. to delegate all powers and functions vested in her, including the power to make enactments and all other areas where the Minister has authority to act, to Assistant Social Security Ministers – Deputy J.M. MaÇon and Deputy S.M. Wickenden, if she is unavailable, so that they are able to cover her functions.

2. to delegate the ability to make decisions under Article 8(2) of the Income Support Jersey Law 2007 to Determining Officers appointed under the Income Support Law. Determining Officers will have the power to make a payment equivalent in value for up to 21 days Short term Incapacity Allowance  

3. to delegate the ability to make decisions under Article 8(2) of the Income Support Jersey Law 2007 to Determining Officers appointed under the Income Support Law. Determining Officers will have the power to make payments of Income Support to a household which would not normally be entitled because they have not supplied all of the written proofs required by the legislation

Reason(s) for Decision: In addition to existing delegations, to ensure continued efficient administration, the Minister for Social Security has extended the above delegations due to Covid19 (Coronavirus).

Resource Implications: None as a consequence of this decision

Action required: Greffier of the States is requested to present the report to the States
