South Hill Development Brief: Public Consultation

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

  1. Purpose of Report

The purpose of this report is to enable the Minister to review draft supplementary planning guidance for the development of the South Hill site for consultation.

 

  1. Background

This site has been identified as appropriate for redevelopment as part of the rationalisation of the public estate. It is also a strategic public asset that can help to meet the objectives of Government to regenerate St Helier and the island’s development needs.

To enable the release of the site for redevelopment by the States of Jersey Development Company (SoJDC), there is a requirement for the Minister for the Environment to adopt and issue supplementary planning guidance.

 

  1. Discussion

The primary aim of the draft development brief is to introduce new open market residential or visitor accommodation into the area helping to contribute to the development of a vibrant St Helier waterfront.

The Minister set out the proposed direction of the emergent guidance of the development brief to the Regeneration Steering Group on 23 October 2019 in order that the RSG might consider the economic viability of subsequent development plans in response to it[1].

The document has been further developed to include the following requirements:

         specific environmental performance of the development;

         specific enhancements to pedestrian access to/from the site;

         the need to assess and mitigate risks relating to defined safety hazards; on-site contamination of land and buildings; and the stability of adjacent slopes.

 

  1. Consultation

There is no prescribed requirement to undertake consultation on the development of supplementary planning guidance except with ‘any Minister or statutory authority with an interest in the development’.[2] It is, however, considered that a standard six-week public consultation exercise should be carried out and that the formal views of the Ministers for Infrastructure; Children and Housing; Economic Development; and Treasury and Resources should be sought before SPG is reviewed and adopted, and becomes material to the determination of subsequent planning applications.

  1. Recommendation

On the basis of the above, the Minister for the Environment is recommended to:

  • approve the South Hill Development Brief: Consultation Draft for publication;
  • authorise a public six-week public consultation, together with formal consultation with ministers as specified in the report.
