Jersey Fishery Officers and British Sea Fisheries Officers: Appointments

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister appointed as Jersey Fishery Officers and British Sea Fisheries Officers the individuals named in the accompanying report.

Jersey Fishery Officers are appointed under Article 15(1) of the Sea Fisheries (Jersey) Law 1994) and British Sea Fisheries Officers under Article 7(1) of the Sea Fisheries Act 1968 as extended to the Channel Islands.

Reason(s) for Decision: 

To update the list of Jersey Fishery Officers and British Sea Fisheries Officers following restructuring within the Department of the Environment.

Resource Implications:

There are no financial or manpower implications.

Action required:

Marine Resources Section Leader to ensure newly appointed Fishery Officers are issued identification cards.

Appointment of Fishery Officers

 

Purpose of the Report

 

For the Minister to approve a revised list of Jersey Fishery Officers and British Sea Fisheries Officers.

 

Background

 

Jersey Fishery Officers may be appointed by the Minister under the Sea Fisheries (Jersey) Law 1994.

British Sea Fishery Officers may be appointed by the Minister under the Sea Fisheries Act 1968 extended to Jersey by the Sea Fisheries (Channel Islands) Order 1973.

 

All staff employed within the Marine Resources Section of the Department of the Environment  are appointed as Jersey Fishery Officers and British Sea Fishery Officers. A number of other personnel in the Department are also appointed as Jersey Fishery Officers, as their duties may involve them in fisheries enforcement issues on an occasional basis.

Restructuring of the Marine Resources Section has resulted in the retirement of one member of staff and the appointment of a second Relief Helmsman.  Additionally, Directors of the Environment Department have taken on some responsibilities in respect of enforcement decision making processes and it is therefore appropriate that they be appointed as Jersey Fishery Officers.

 

Discussion

 

Dr Simon Bossy (Head of Fisheries and Marine Resources) and Edward Prouten (Agricultural Inspector) both took Voluntary Redundancy earlier this year with the loss of their posts. As part of a restructuring process, Directors William Peggie, Daniel Houseago and Dr Timothy du Feu have all taken on some of the responsibilities previously held by Dr Bossy and may occasionally need the powers of a Fishery Officer.

Steven Manning has been employed as a Relief Skipper on a zero hours contract basis for some 6 months and whilst not employed directly on enforcement duties, may occasionally need to employ the powers of a Fishery Officer (typically to order a fishing vessel to stop).

 

All newly appointed Fishery Officers have received training appropriate to the roles they will undertake.
