Television Licensing - Fee Increases.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Television Licensing - Fee Increases.

Report on the 2009 amendment to the Communications (Television Licensing) Regulations 2004 (S.I. 2004/692)

As provided for as part of the licence fee settlement with the BBC, television licence fees are required to keep in line with the cost in production of public service broadcasting.  Licence fee payers in Jersey have not previously been able to take advantage of the full range of payment options available to licence holders in the United Kingdom and this Regulation extends two payment schemes to the Island in order to provide the greatest possible choice.

To that end these Regulations provide for increases in the sums to be paid for different categories of licences set out in the 2004 Regulations, and in the sums payable by way of instalments under instalment schemes set out in those Regulations.

In summary—

  1. the fee for a basic black and white only TV licence is increased from £47.00 to £48.00, and that for a basic colour TV licence from £139.50 to £142.50;
  2. the premium instalment licence payment scheme is extended to Jersey;
  3. the easy entry television licence payment scheme is extended to Jersey;
  4. the issue fee and subsequent instalments for the premium instalment licence are raised to £36.89 and £36.87 respectively, the total payable rising from £144.50 to £147.50;
  5. amendments are made in relation to the instalments payable for the budget instalment licence and easy entrance licence so that in every case the total amount payable is raised from £139.50 to £142.50;
  6. the provisions relating to TV licence fees for accommodation for residential care are amended to increase the fee for each unit of accommodation specified in the licence to £7.50; and
  7. the provisions relating to TV licence fees for hotels, hospitality areas and mobile units are amended to reflect the rise in the fees payable for basic black and white only and colour TV licences to £48.00 and £142.50 respectively.
